SUBJECT: Report on Assembly Bill 414
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS
Discuss Assembly Bill 414 by Assemblymen Sher and Cunneen, which
would revise the process for obtaining vehicle registration fee
funds for transportation measures which improve air quality and
determine position.
FISCAL IMPACT
None.
BACKGROUND/REASONS FOR RECOMMENDATIONS
In 1991, the: Legislature passed Assembly Bill 434, which the Board
supported. This bill raised the vehicle registration fee in the
San Francisco Bay Area, initially by $2 . 00 and later by $4 . 00 , and
allocated the funds to the Bay Area Air Quality Management District
to award as grants for projects that reduced air pollution. Seven
specific types of eligible projects were identified in the bill .
The Air District controls 60% of the funds and returns 40% to the
county of origin for disbursement . The Contra Costa Transportation
Authority has been designated as the program manager for the 400-.
funds in this county, which currently amount to more than $1
million. Most of the CCTA funds are allocated to the regional
transportation planning committees, which administer local trip
reduction ordinances . The County has received AB 434 grants from
the Air Distict to support the telecommuting pilot program and for
traffic signal coordination projects .

Assembly Bill 414 makes the following changes to the process of allocating AB 434
funds : (1) the Air District and county program managers must hold annual public
hearings to review the expenditure of fee revenues; (2) any agency receiving
funds must encumber and expend those funds within 2 years; (3) agencies can use
the funds for employer trip reduction programs only if they have accepted
delegation of authority from the District to implement BAAQMD Regulation 13 ; (4)
bicycle and pedestrian improvements are now eligible for funding; (5)
telecommuting programs are eligible projects .
These changes increase the number of potential eligible uses for AB 434 funds and
improve accountability by requiring public hearings to review the use of funds
and setting a time limit on the expenditure of funds . The Contra Costa
Transportation Authority also supports this bill, as amended.
