S FROM: PHIL BATCHELOR '�,.� County County Administrator DATE: May 23, 1995 SUBJECT: APPLICATION FOR FEDERAL JUVENILE BOOT CAMP PLANNING FUNDS Specific Request(s) or Recommendation(s) & Background & Justification RECOMMENDATION: Authorize the County Administrator or his designee to submit an application for $50, 000 in planning funds for Fiscal Year 1995-96 from the Corrections Boot Camp Initiative authorized in the Violent Crime Control and Law Enforcement Act and execute a Memorandum of Understanding with the State of California (The Resources Agency) California Conservation Corps for program design and coordination purposes . FINANCIAL IMPACT: The Boot Camp planning grant requires $15,000 in County match. County funds for this match are available within existing appropriations . REASONS FOR RECOMMENDATION/BACKGROUND: At this time, the California Conservation Corps has been unable to locate a specific site to allow for the submission of a construction grant application. The County will submit a planning grant, in collaboration with the Conservation Corps, to provide the time and funds necessary to develop a detailed plan from the currently proposed concept. The planning effort will determine the feasibility of operating the model Youth Corps program in Contra Costa County. Contact: George Roemer ( 646-4855) Attested: May 23 , 1995 cc: CAO - Justice System Programs Phil Batchelor, Clerk of Criminal Justice Agency the Board of Supervisors Auditor-Controller and County Administrator By: �' � , DEPUTY MEMORANDUM OF UNDERSTANDING THIS MEMORANDUM OF UNDERSTANDING is executed this 23rd day of May, 1995, by and between the STATE OF CALIFORNIA, RESOURCES AGENCY (CALIFORNIA CONSERVATION CORPS), hereinafter referred to as CONSERVATION CORPS, and CONTRA COSTA COUNTY, hereinafter referred to as COUNTY, to provide a basis for the establishment and maintenance of a Contra Costa Youth Corps. This agreement confirms the mutual interest of the parties to help redirect high-risk youth to become productive, law- abiding citizens. A. The CONSERVATION CORPS agrees to: 1 . Submit an application in collaboration with COUNTY for$50,000 in planning funds for Fiscal Year 1995 from the Corrections Boot Camp Initiative authorized in the Violent Crime Control project. 2. Provide 60% funding for the first year for staffing and operations costs, 55% for the second year, and 50% for the third and subsequent years' staffing and operation costs provided that evaluation results of the project indicate its effectiveness and provided that the Legislature appropriates sufficient funds for this purpose (the CONSERVATION CORPS may immediately terminate this agreement by giving written notice to the COUNTY if the grant referred to in the foregoing paragraph is not obtained or if for any other reason sufficient funds are not appropriated and available to meet any obligation undertaken by the CONSERVATION CORPS pursuant to this Memorandum of Understanding). 3. Provide daily operational supervision and administration to the program with a minimum of three staff on site twenty-four (24) hours per day, seven (7) days per week. 4. Indemnify, hold harmless, and defend COUNTY, its officers, employees, and agents from and against any and all losses and expenses (including costs of attorney's fees) by reason of liability imposed by law upon COUNTY for damages because of bodily injury, personal injury, including death at any time resulting therefrom, sustained by any person or persons or on account of damage to property, including loss of use thereof, arising out of or in consequence of the performance of this agreement, in proportion to and provided such injuries to persons or damage to property are due or claimed to be due to the negligence or willful misconduct of CONSERVATION CORPS, its officers, paid employees, and/or agents. Page 1 Memorandum of Understanding Contra Costa Youth Corps B. The COUNTY agrees to: 1. Submit an application ii`, collaboration with the CONSERVATION CORPS for $50,000 in planning funds for Fiscal Year 1995 from the Corrections Boot Camp Initiative authorized in the Violent Crime Control project and provide_ a 25% local funding match required by the granting agency. 2. Provide annually the required matching funds of 40% for the first year for staffing and operations costs, 45% for the second year, and 50% for the third and subsequent years' staffing and operation costs provided that evaluation results of the project indicate its effectiveness. 3. Provide, as part of the required operational funds, one deputy probation officerwho will be responsible for individualized case management, intensive aftercare, transition and follow-up services for participating youngsters. 4. Recommend youth meeting the eligibility criteria for participation in the program. 5. Identify a control group for future evaluation purposes and provide statistical data as needed regarding high-risk juvenile population. 6. Indemnify, hold harmless, and defend CONSERVATION CORPS, its officers, employees, and agents from and against any and all losses and expenses (including costs of attorney's fees) by reason of liability imposed by law upon CONSERVATION CORPS for damages because of bodily injury, personal injury, including death at any time resulting therefrom, sustained by any person or persons or on account of damage to property, including loss of use thereof, arising out of or in consequence of the performance of this agreement, in proportion to and provided such injuries to persons or damage to property are due or claimed to be due to the negligence or willful misconduct of COUNTY, its officers, paid employees, and/or agents. C. Both parties agree that: 1 . The program will be identified as "Contra Costa Youth Corps." 2. The program will be a six month residential program for thirty (30) youth of ages 15 to 17 years designed to provide work experience, remedial education, and service to the community through projects that are anticipated to include (but not necessarily be limited to) park clean-up, trails and habitat restoration, and other restitution projects. The program will be limited to wards of the Page 2 Memorandum of Understanding Contra Costa Youth Corps court who are minimally involved in the justice system and will exclude youth with a current or prior violent offense, including a sex or arson offense. ` The CONSERVATION CORPS, and officers of the COUNTY District Attorney, Probation Department and the Presiding Juvenile Court Judge will jointly determine eligibility. 3. The Contra Costa County Office of Education will by separate agreement provide on-site instructors and education materials. 4. Community involvement and input will be an important element of the program. S. In accordance State and County policy and applicable State and Federal laws, not discriminate in any of their policy, procedures or practices on the basis of race, color, creed, national origin, citizenship, religion, sex, sexual orientation, handicap, age, veteran status, medical condition (as defined in Section 12926 of the California Government Code), ancestry, or marital status, and in accordance with applicable law be an affirmative action/equal opportunity employer. 6. This agreement shall be effective upon execution and may be terminated by either party at its sole discretion upon thirty (30) days advance written notice thereof, to the other, or cancelled immediately by written mutual consent or terminated by the CONSERVATION CORPS as set forth in Paragraph A.2. above. It was noted that at this time, the California Conservation Corps has been unable to locate a specific site to allow for the submission of a construction grant application. At the conclusion of the discussion on this matter, the Board: 1. REFERRED the issue of site selection to the City County Relations Committee and the County Youth Commission for input; and 2 . REQUESTED that a Board delegation attend a County Superintendent of Schools meeting in order to gain their input on this matter.
