FISCAL IMPACT None. BACKGROUND/REASONS FOR RECOMMENDATIONS AB 368 is legislation that would authorize a redevelopment agency to use up to 300 of its low and moderate income housing fund outside of its jurisdiction for emergency and transitional housing. The County of San Mateo is the sponsor of AB 368 . They have requested that redevelopment agencies throughout the State support the bill in order to broaden local participation in the development of emergency and transitional housing. The California Rural Legal Assistance Foundation and the Western Center on Law and Poverty oppose the legislation on the grounds that it represents a transfer of redevelopment low and moderate income housing funds without desired conditions and protections against discrimination. Local resources to address the problems of homelessness are already overstretched. Federal support has been diminishing. In view of these circumstances, the proposal contained in AB 368 (Speier)that would authorize a Redevelopment Agency to use up to 30% of its low and moderate income housing fund outside of its jurisdiction for emergency transitional housing is appropriate. The legislation is appropriately permissive, and maintains local discretion as to the actual use of such funds for emergency and transitional housing. We ask that you support AB 368 as it moves through the Legislature.
