RESOLUTION 95-14
ELECTION SPECIFICATIONS
The Governing Board of the Moraga School District RESOLVES THAT:
Elections Code 10012 authorizes the Governing Board to determine the maximum length of
and method of payment for printing, translating, and distribution costs of Governing Board
candidate's statements of qualifications. Education Codes 5016 and 5304 authorize the Board to
determine the method of determining the winners of an election in the event of a tie vote. For the
Regular Governing Board Member Election scheduled to be held on November 7, 1995, the
following regulations shall apply:
1. A candidate's statement of qualifications is limited to 200 words with no other material
permitted.
2. Each candidate filing a statement of qualifications shall pay prorata costs of printing, handling,
translating, and mailing the statement as provided in Elections Code 10012.
3. Each candidate shall, as a condition of filing a statement of qualifications, pay in advance the
estimated costs of printing, handling, translating, and mailing the statement.
4. In the event of a tie vote, the winner(s) shall be determined by drawing lots in accordance with
Education Code 5016.
Pursuant to Education Code 5322, this Board orders the Contra Costa County
Superintendent of Schools to call a governing board member election to be held on November 7,
1995, in the Moraga School District and to request that said election be consolidated with other
elections to be held on the same date in the same territory.
The Superintendent is directed to forward a certified copy of this Resolution to the Contra
Costa County Registration-Election Department and to the County Superintendent of Schools.

Costa County on May 9, 1995, by the following vote:
AYES: Deborah Dixon, Deborah Schwab Levine, Eileen Burke, Lauri Fidell Granoff

At the regular meeting of the Board of Education on May 11, 1995, the enclosed
Regulations for Governing Board Member Election and resolution relative to the
holding of a consolidated election were adopted for the Governing Board Member
Election to be held on Tuesday, November 7, 1995. A copy of the resolution has
been forwarded to the County Superintendent of Schools and to the County
Registration-Election Department.
Encumbents Nancy Hobert and Raymond Ulmer are up for re-election this year.
The District will also seek to fill the vacancy created by the resignation of Board
Member Robert Repicky. These are full term offices.

REGULATIONS FOR GOVERNING BOARD MEMBER ELECTION
Statement of Qualifications
Any person who files as a candidate for the Governing Board and also files a
Statement of Qualifications will pay the cost of Statement, not to exceed 200 words.
The cost will be determined by the County Elections Department. No additional
materials are to be mailed.
Tie Vote
In the event of a tie vote there will be a drawing by lot to determine the winning
candidate.

WHEREAS,Education Code Section 5322 requires that in the event of any ordered election,
a resolution be delivered to the County Superintendent of Schools and the officer conducting the
election;
NOW, BE IT THEREFORE RESOLVED that this Board orders the Superintendent of
Schools of Contra Costa County to call an election. The purpose of the election is the election of
board members. This election is to be held on Tuesday, November 7, 1995.
The secretary of the Board of Education is hereby authorized and directed to certify the
adoption of this resolution and to transmit certified copies hereof to the County Election"Supervisor
and the County Superintendent of Schools.

Dear Mr. Delavati:
Pursuant to your request, I submit to you two (2) policies of the Governing Board of the
Pittsburg Unified School District; Policies Nos. 9511 and 9513. Also enclosed is a copy of
Resolution 94-57 adopted by the Board May 10, 1995 as required by Ed. Code Section 5322
relative to the holding of a Consolidated Election.
Two (2) full-term positions on the Governing Board are up for election. These positions are
currently being held by Orin T. Allen (reelected in 1991) and Marlene Cacciola (reelected in
1991).

Bylaws of the Board 9511
Candidate's Statement of Qualifications
The governing board directs, with respect to statements of qualifications
for candidates who run for office of member of the governing board of the
district, that
1. with the exception of the costs of providing a Spanish translation,
which costs shall be borne by the district, the costs of printing,
handling and mailing a candidate's statement of' qualifications shall
be charged to -the candidate. The prorated share of the estimated cost
shall be paid at the time of filing.
2. candidates shall not be permitted to submit additional materials to
be sent to the voter with the sample ballot.
3. the statement of qualifications shall not exceed 200 words.
4. the registrar of voters shall be directed to give a copy of these
regulations to each candidate or his/her representative at the time
the candidate or representative picks up his/her nomination papers.
This bylaw shall remain in full force and effect until rescinded by this
board. In any event, the governing board recognizes that, in accord with
law, this bylaw must be adopted by the governing board before the nominating
period for election opens, i.e. , more than 89 days before the election, and
that the bylaw may not be revoked or modified after the 7th day before the
opening of the nominating period.

Tie Votes in Board Member Elections
If a tie vote makes it impossible to determine which of two or more candidates
has been elected to the {governing board, the governing board shall determine
the winner(s) by lot.
