SPECIFIC REQUESTS) OR RECOMMENDATIONS) & BACKGROUND AND JUSTIFICATION
I. Recommended Action:
APPROVE project, and
DETERMINE that the project is a California Environmental Quality Act Class 1 Categorical
Exemption, and DIRECT the Public Works Director to prepare contract plans and specifications
for construction, and
DIRECT the Director of Community Development to file a Notice of Exemption with the County
Clerk, and
DIRECT the Public Works Director to arrange for payment of the $25.00 handling fee to the
County Clerk for filing of the Notice of Exemption.
If. Financiallmpact:
The estimated cost of the project is $40,000 which will be funded by Transportation Development
Act (TDA) funds (100%).
There is no impact to the County's General Fund.
III. Reasons for Recommendations and Background:
The project consists of constructing a four foot decomposed gr nit or asphalt path along the
south side of Newell Avenue between Magnolia Way an Lil e. Currently no sidewalk or

children access to the local schools in the area. The need for the project was brought to the
attention of the Public Works Department by the Parkmead Community Association and several
residents.

Community Development staff has reviewed the attached project, CP 954& to determine
if mandatory referral for General Plan Conformance, as required by Section 65402 of the
Government Code, is necessary.
The project needs no further mandatory referral clearance from County staff subject to the
following actions:

95-26: The proposed project involves constructing an approximately 1,500 linear foot pedestrian pathway
on the south side of Newell Avenue extending east from Magnolia Way to Lilac Drive. Approximately 28
mature trees are located at the edge of the proposed pathway. The trees show signs of stress from
Inadequate pruning practices, pollution from vehicular traffic,and soil compaction. The presence of disease
or insect activity Is indicated on some trees. To minimize further damage and to protect the trees, measure
such as hard excavation, pruning, and cutting tree roots in a flush manner,are incorporated into the project,
These measures shall be performed In accordance with recognized standards of good arboricultural practices.
The pathway will be constructed of either crushed rock, compacted to form a smooth, hard surface or
asphalt. The pathway width of 48 inches narrows to 36 inches at obstacles (e.g., trees and utility poles).
The minimum width for a signal wheelchair is 36 inches thus making the pathway accessible to all
neighborhood residents. Eight wheelchair ramps will be Installed as part of the project on Magnolia Way,
Azalea Drive, Marigold Lane, Idlewood Drive, and Lilac Drive. Subject project is located as follows: The
project is located in the central residential area of Walnut Creek.
This project is exempt from CEQA as a:
