SUBJECT: Resolution and Notice of Intention
to Convey Real Property to the
City of Antioch
West Antioch Creek Surplus
Project No. 7579-6D8307
Antioch Area
The Board of Supervisors of Contra Costa County RESOLVES THAT:
This Board intends to convey to the City of Antioch, County owned real property
described in the attached Notice for$74,000 in accordance with the terms and conditions
of the Purchase Agreement on file in the Public Works Department.
This property is not required for County use and the sale price is the market value
of said property.
This Board hereby sets Tuesday, June 27, 1995, at 9:30 a.m. in the Board's
Chambers in the County Administration Building, 651 Pine Street, Martinez, California, as
the time and place it will meet to consummate this conveyance by a four-fifths vote.
The Clerk of this Board is hereby DIRECTED to have the attached Notice published
one time, at least one week preceding the date set for hearing in the Antioch Ledger, a
newspaper of general circulation (pursuant to Government Code Section 6061).
The Board hereby FINDS that the project will not have a significant effect on the
environment, and DETERMINES that the project is exempt from the requirements of the
California Environmental Quality Act as a Class 12 Categorical Exemption under County
Guidelines and Section 15312 of the State CEQA Guidelines, and DIRECTS the Director
of Community Development to file a Notice of Exemption with the County Clerk and
DIRECTS the Public Works Director to arrange for payment of the $25.00 handling fee to
the County Clerk for filing of the Notice of Exemption. This activity has been found to
conform to the General Plan of the City of Antioch.

Commencing at the northwest comer of said PARCEL THREE; thence along the west line
thereof, south 0001'30" east 4.75 feet, to the Point of Beginning on a non-tangent curve
concave to the south having a radius of 515.00 feet to which a radial bears north 7°44'40"
west; thence from the Point of Beginning along the arc of said curve, easterly 68.21 feet,
through a central angle of 7035'19"to the east line of said PARCEL THREE; thence along
the boundary thereof as follows: 1) south 0001'30" east 199.92 feet, 2) south 89058'30"

Notice is further given that it is proposed to convey said property to the City of Antioch for
$74,000, being the fair market value of the property.
The Board will meet on Tuesday, June 27, 1995, at 9:30 a.m. in the Board's Chambers,
County Administration Building, 651 Pine Street, Martinez, California, to make such
conveyance by at least a four-fifths vote.

GENERAL CONSIDERATIONS:
1. Location: The proposed project is located at the 4th Street crossing of West
Antioch Creek in the Antioch area of east Contra Costa County (see Figures 1 and
2).
2.. : Project "Description: The proposed project involves the sale of approximately
17,500 sq. ft. of vacant surplus property to the City of Antioch (see Figure 3).
Approximately 4,000 sq. ft. of the land is needed for improvements to 4th Street and
the balance will be available to.the City for development/redevelopment purposes.

been reviewed by the Community De el ment Department. Please review the documents to determine if
there are any positing periods and/or hearings required before the Board of Supervisors can take action on

When the Board of Supervisors takes action on the project, it must "review" and "consider" the
environmental impact report or negative declaration,together with any comments received during the public
review process. They must then adopt the environmental document before approving the project. You
must,therefore, provide copies for each member of the Board of the respective environmental impact report,
notice of negative declaration, or the notice of exemption, along with any comments received during the
review period. They must review and consider these items before approving the project. If they do not
physically have the documents, they cannot consider them.
In the case of projects which are exempt from CEQA, the Board Order should concur in the determination
that the project is categorically exempt, and direct the filing of the Notice of Exemption.
PLEASE NOTIFY US, WITHIN 2 DAYS OF THE BOARD HEARING ON THIS PROJECT, WHAT ACTION THE
BOARD TOOK SO THAT WE CAN INITIATE THE FILING OF THE NOTICE OF EXEMPTION OR NOTICE OF
DETERMINATION WITH THE COUNTY CLERK. THE FILING OF THESE NOTICES STARTS THE STATUTE
OF LIMITATIONS ON COURT CHALLENGES TO THE APPROVAL UNDER CEQA. HENCE, THE FILING OF
THESE NOTICES ARE IMPORTANT SINCE IT LIMITS THE COUNTY'S LIABILITY.

SUBJECT: MANDATORY REFERRAL FOR GENERAL PLAN CONFORMANCE
Community Development staff has reviewed the attached project, CP 95-10to determine
if mandatory referral for General Plan Conformance, as required by Section 65402 of the
Government Code, is necessary.
The project needs no further mandatory referral clearance from County staff subject to the
following actions:
( ) This project has been determined to be exempt from 65402 review.
( ) This project has been determined to be exempt from 65402 review in
accordance with the Board of Supervisors Resolution 81/522 because the
project involves a road alignment project of a minor nature.
( ) This project should be referred to the City offor 65402 review.
Community Development staff makes the following attached recommendation
which should be incorporated into the staff report on this matter.
The project needs mandatory referral and County staff will process this project in the
following manner:
( ) 65402 review is required. Community Development staff will carry this matter
before the appropriate Planning Commission.
( ) 65402 review must be withheld until completion of an Environmental Impact
Report on this project.

Antioch Creek at 4th Street, Antioch, Surplus). In conformance with Contra Costa County Guidelines for
implementing the California Environmental Quality Act of 1970 (CEQA), it has been determined that your project
will not have a significant effect on the environment. Your project falls within the following category:
