FINANCIAL IMPACT: This Certificate of Maintenance of Effort is required by State statute as implemented by guidelines issued by the Office of State Controller. Failure to submit the required certification form would result in the loss of $38 .2 million in State Proposition 172 funds for the current fiscal year. REASONS FOR RECOMMENDATION/BACKGROUND: In FY 1993/94, this County received $36,591,745 in public safety sales tax funds (Prop 172 ) . In FY 1994/95, it is estimated that we will receive $38 .2 million. All of these estimated funds have been budgeted in the District Attorney and Sheriff budgets, pursuant to Board action. For the current year, it is estimated that Proposition 172 funds will pay for 45% of the Sheriff's total budget and 28% of the District Attorney's budget ( including family support operations) . During the 1994 legislative session, AB-2788 was enacted into statute (Chapter 886 , Statutes of 1994 ) . This 1/2 cent sales tax was authorized in 1994 as a result of the 1993/94 state budget. Proposition 172/SB-509 designated that the 1/2 cent sales tax be deposited to newly-created state and local public safety trust funds and allocated to local agencies to fund public safety activities such as police, sheriff, fire, district attorney, county corrections and ocean lifeguards . Specifically, court operations were excluded. This law further required that a County maintain its funding level for public safety services in order to continue to qualify for Proposition 172 money. The law does not define in detail what is meant by "public safety services" and allows each county to make its own computation. In implementing the Maintenance of Effort section of AB-2788, as indicated in the Certification Form, it is most advantageous for this County to define public safety as follows : District Attorney (Budget Unit 242) , Probation (BU 308) , Public Defender (BU 243) , Sheriff-Coroner (BU 255, 300 and 359) , and Inmate Medical Care (BU 301) . For FY 1994/95, this results in this County being $9, 014, 124 over its AB-2788 Maintenance of Effort requirement. If we limited the definition of public safety under AB-2788 solely to the District Attorney and Sheriff-Coroner Departments, we would be over our Maintenance of Effort requirement by $6,798, 053 . In any event, we are far in excess of what we need to meet the basic Maintenance of Effort requirement. Authorizing the County Administrator or Designee to execute the Form and submit it to the County Auditor-Controller will assure that we will receive our full allotment of Proposition 172 Funds for the current year. In computing the maintenance of effort, we followed the Public Safety Services Maintenance of Effort Requirement Uniform Guidelines for California Counties and Cities approved by the State Association of County Auditors . It should be noted that the definition of "public safety services" for computation of the Maintenance of Effort requirement does not in any way detract from the Board' s authority to designate those funds to whatever public safety department it chooses . As mentioned above, only the District Attorney and Sheriff departments receive Proposition 172 funds which fall far short of funding those total budgets . Please list all departments included in this definition below. District Attorney, Probation, Public Defender, Sheriff (including Coroner), Health Detention-Inmates. Step #2: Determine, Base Year The city or county should determine their AB2788 base year by using the -1992- 93 Adopted Budget for all defined public safety departments. Please complete Form B to provide the following: Line 2. 1: Total Base Year $88,305,463 (Total Adjusted AB2788 Base Year detailed in Form B) Step #3: Determine Base Amount for Local Agency AB2788 includes a growth factor provision that is equal to the previous years' growth in Proposition 172 revenues. The Auditor-Controller's Office :ill provide cities and counties with this amount. If appropriate, this amount should be added to the AB2788 Base Year.
