RE: LIQUOR LICENSE
I currently hold an Off- Sale beer/wine license and have applied
for an Off-Sale Liquor license for this location with the
Department of Alcoholic Beverage Control.
For issuance of the license, the ABC requires a letter from the
County Board of Supervisors as stated in the attached APPLICANT
INSTRUCTIONS from the ABC.
I would highly appreciate if you would issue the required letter
as soon as possible.

Dear Applicant:
Effective January 1, 1995, Business and Professions Code Section 23958 was amended
and now mandates the Department deny an,application for a retail license if issuance of
that license would tend to create a law enforcemeriLproblem, or if issuance would result in
or add to an due. concentration of licenses.
For purposes of this portion of Section 23958, "law enforcement problem", means that
applicant premises for an original or premises to premises transfer of any retail license
located in an area where the following condition exists:
(1) The applicant premises are located in a crime reporting district that has a 20% greater
number of reported crimes in a geographical area within tate boundaries of a single
governmental entity (city or the unincorporated area of a county) than the average
number of reported crimes as determined from all crime reporting districts within the
jurisdiction of the local law enforcement agency that are identified by the local law
enforcement agency in the compilation and maintenance of statistical information on
reported crimes and arrests.
(2) Undue Concentration is statutorily declared to exist when an original application or a
premises-to-premises application is made for:
a) A retail on-sale license in a census tract where the ratio of existing on-sale retail
licenses to population in the census tract exceeds or will exceed the ratio of retail on-sale
licenses to population in the county of the proposed premises: or
b) A retail off-sale license in a census tract where the ratio of existing off-sale retail
licenses to population in the census tract exceeds the ratio of retail off-sale license to
population in the county of the proposed premises.
Notwithstanding Section 23958, the Department may issue a retail license in an area
deemed to be a high crime area by the local law enforcement agency or in an area that has
an over concentration of retail licenses, if the local governing body (City Council or
County Board of Supervisors) of the area in which the applicant premises are located
determines that public convenience or necessity would be served by the issuance.

Before your applWation for your retail license can be processed you are required to submit
to the Department an official letter (documentation) showing that public convenience ox
necessity would be served from the local governing body, City Council, County Board of
Supervisors or the designated representative of the jurisdiction in which your proposed
premises is located. The letter from the governing body must specifically request issuance
of the applied for license and explain how public convenience and necessity would be
served.
