SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
I. Recommended Action:
A. APPROVE Right of Way Contract and ACCEPT Grant Deed dated March 6, 1995 from David
Kuhner, trustee and Dorothy Crook, trustee.
B. AUTHORIZE Chief Engineer to execute said Right of Way Contract on behalf of the District.
C. APPROVE payment of $ 23,000.00 for said property rights and AUTHORIZE the Auditor-
Controller to issue a check in said amount payable to Old Republic Title Company, 3685 Mount
Diablo Boulevard, Suite 1100, Lafayette, CA 94549, Escrow No. 185200, to be forwarded to the
Real Property Division for delivery.
D. DIRECT the Real Property Division to have the above referenced Grant Deed recorded in the
office of the County Recorder.

PARCEL 1536: (Fee Title)
A portion of the parcel of land described in the deed to David Kuhner, et al, recorded May
9, 1984 in Book 11780 of Official Records at page 672 records of Contra Costa County,
State of California, described as follows:
Commencing at the intersection of the east line of the Atchison Topeka and Santa Fe
Railroad (A.T.&S.F.R.R.) right of way and the southeasterly line of the parcel of land
described in the deed to Standard Pacific Gas Line Company Incorporated, a Corporation
(formerly Federal Engineering Company) recorded March 12, 1930 in Book 228 of Official
Records at page 40 records of said County; thence leaving said point of commencement
along said east line of the A.T.&S.F.R.R. right of way north 5'12'03" east 146.08 feet to
the Point of Beginning for the herein described parcel; thence from said Point of
Beginning, leaving last said line, north 65°12'04" east 39.62 feet; thence south 24°47'56"
east to the centerline of Wildcat Creek; thence southwesterly along the meander line of
Wildcat Creek to said east line of the A.T.S.F.R.R. right of way; thence along said line
north 5°12'03" east to the Point of Beginning.
Containing an area of 3,160 square feet of land more or less.
PARCEL 1536A: (FLOATING EASEMENT)
A portion of that parcel of land described in the deed to David Kuhner, et al, recorded May
9, 1984 in Book 11780 of Official Records at page 672, records of Contra Costa County,
California, described as follows:
A nonexclusive floating access easement over a strip of land 20.00 feet in width with a
minimum 50.00 feet centerline turning radius for any turns in said access strip, extending
from the northerly line of the Wildcat Creek Flood Control Channel, northerly and easterly
to the east line of said Kuhner parcel (11780 O.R. 672) at the westerly right of way line of
the public road known as Rumrill Boulevard. The location of said floating easement to
follow driveways or access routes on said Kuhner parcel as they may be located or
relocated in this area from time to time or by such other route mutually agreeable between
the parties hereto.
In the event Grantee determines that said Floating Easement is no longer necessary for
its purposes, then all rights of Grantee in and to said floating easement shall thereupon
cease and terminate and title thereto shall revert to and vest in Grantor. Grantee shall
execute any quitclaim deed required in this regard.
