MICHAEL WALFORD, PUBLIC WORKS DIRECTOR DATE: April 25, 1995 SUBJECT: HEARING ON PROPOSED PRIORITY LIST OF THE TRANSPORTATION DEVELOP- MENT ACT ARTICLE 3 FUNDS FOR BICYCLE/PEDESTRIAN PATH PROJECTS FOR FISCAL YEAR 1995-96 SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION I. Recommended Action: APPROVE the following Project Priority List for Contra Costa County's Transportation Development Act Article 3 funds for Bicycle/Pedestrian Path projects for Fiscal Year 1995-96, and DIRECT the Clerk of the Board to forward the list to the Metropolitan Transportation Commission for final approval and allocation of funding effective July 1, 1995. II. Financial Impact: No impact to County General Fund III. Reasons for Recommendations and Background: In 1978, a procedure was recommended by the Conference of Mayors and adopted by the County Board of Supervisors to insure county-wide consensus in funding bicycle and pedestrian projects with Transportation Development Act Article 3 (TDA) money. In 1991, the Metropolitan Transportation Commission (MTC) required TDA applicants to have the TDA projects reviewed by a city or countywide bicycle advisory committee. In accordance with those procedures, each City and the County submitted applications for 1995-96 TDA funds for bicycle and pedestrian facilities. The Countywide Bicycle Advisory Committee reviewed the projects in November of 1994. The TDA Subcommittee, a subcommittee of the City/County Engineers Advisory Committee (CCEAC), met in late December to field review all of the applications submitted for funding consideration. _ RECOMMENDATION OF COUNTY ADMINIST TOR _RECOMMENDATION OF BOARD COMMITTEE APPROVE OTHER SIGNATURE(S): ACTION OF BOARD ON April 25, 1995 APPROVED AS RECOMMENDED x OTHER The hearing was opened. Reasons for Recommendations and Background (cont.): Eleven projects, totaling almost $800,000, were reviewed by the subcommittee. This year's subcommittee is made up of representatives from EI Cerrito, Martinez, Pittsburg, Lafayette, the Metropolitan Transportation Commission, the County, the East Bay Bicycle Coalition, the Regional Bicycle Advisory Committee and the East Bay Regional Park District. The following exhibit lists all of the submitted projects. MTC estimated (preliminary) that $424,000 TDA funds would be available for 1995-96 in Contra Costa County. After reviewing all of the proposed projects and prioritizing the projects using criteria established for that purpose, the subcommittee recommended that the CCEAC accept a project priority list for the 1995-96 TDA Article 3 funds. The CCEAC approved the proposed priority list on January 6, 1995. On March 2, 1995, the Contra Costa Conference of Mayors approved the proposed priority list. In March, after the CCEAC and Mayors Conference had approved the priority list, MTC finalized their TDA fund estimate. The finalized fund estimate is $400,761, which is $23,239 less than originally estimated. This results in reduced funding of the Concord project. However, state law precludes spending more than 5% of TDA funds for bicycle safety education programs. This means a maximum allocation for the Bicycle Safety Education Program of $20,000. Since $39,000 had been recommended for the Bicycle Safety Education Program, $19,000 can be reallocated to the Concord project. This offsets the reduction in the MTC estimate and results in an overall reduction to Concord of$4,239 ($23,239 - $19,000). The MTC fund estimate may still fluctuate somewhat, but not by much. Concord is aware of this reduction in their project funding. The priority list has been reviewed by the Transportation Committee. The CCEAC requests approval of the project list for the 1995/96 TDA Article 3 funds. Subsequent to adoption of the list by the Board of Supervisors, the priority list will be forwarded to the Metropolitan Transportation Commission for final approval and funding allocation. IV. Consequences of Negative Action: Failure to approve the project list will result in a delay in the MTC process of allocating TDA funds in the Contra,Costa County area. MTC's latest fund estimate is $400,761. However state law prohibits spending more that 5% of TDA funds ($20,000) on the Bicycle Safety Education Program. This results in a reallocation of$19,000($39,000-$20,000)which will offset the reduction in the MTC fund estimate. This will result in a net reduction of$4,239 in funding to Concord,with a MTC fund estimate of$400,761.
