The Board of Supervisors of Contra Costa County, California
Adopted this Order on_April 25, 1995 by the following vote:

SUBJECT: Left Turn Lane on Tice Valley Boulevard,Walnut Creek area
The Board considered the report of J. Michael Walford, Public Works Director, regarding the
additional work required to construct a protected left turn lane on Tice Valley Boulevard as part of the Olympic
Boulevard Widening Project.
Patty McNamee of the Public Works Department advised of meetings with the owner of the Saranap
Gas Station and considered options for a left turn lane into the Gas Station from Tice Valley Boulevard. She
reported that an acceptable agreement to all parties was reached last week which also included agreement
on a cost sharing where the owner would pay 100 percent of the actual added cost for the left tum lane
(estimated at$8,900)and the Public Works Department would pay the additional labor cost(estimated at
$7,800).
Edward Shaffter, representing Norman and Paul Borgward, 3260 Blume Drive,#200, Richmond,
advised that the property owner reluctantly accepts bearing the construction costs as required by the Public
Works Department, but has some concern if his costs or liability might increase because of cost overruns for
which he would have not control.
There was general agreement among Board members to limit the cost of the property owner to
$8,900.
As moved by Supervisor Smith and seconded by Supervisor Torlakson, IT IS BY THE BOARD
ORDERED that Plan A and staff's recommendations are ACCEPTED as amended to include the limit of
exposure to the property owner to be$8,900 and that any amount of cost over that as stated is to be borne by
the County.
In moving the motion, Supervisor Smith clarified that the vote was intended to include the approval of
Agenda Item 1.2 which includes the award of the contract for this project. Board members were in agreement.

I. Recommended Action:
ACCEPT report from the Public Works Director regarding the additional work required to
construct a protected left turn lane on Tice Valley Boulevard as part of the Olympic Boulevard
Widening Project and APPROVE the Public Works Director recommended Alternative Plan A, the
cost sharing proposal and other conditions outlined in said report for construction of this left turn
lane.
REAFFIRM the issuance of a change order to effect the construction of this left turn lane,
conditioned upon the Saranap Filling Station owner's fulfillment of his obligations Listed in said
report.
AUTHORIZE the Public Works Director to enter into a Road Improvement Agreement with the
Saranap Filling Station owner, as required in said report.
11. FinancialInVact:
The total estimated cost to construct the left turn lane leading into the Saranap Filling Station,
based on the recommended Alternative Plan A is $16,700. The recommended County estimated
share is$7,800, which would be 100% paid by County Road Funds. The Saranap Filling Station
owner would pay 100% of the additional actual construction and utility re-engineering cpsts
(estimated at $8,900).

III Reasons for Recommendations and Background - Public Works Director Report:
On March 7, 1995, the Board of Supervisors approved the Plans and Specifications for the
Olympic Boulevard Widening Project, (Consent Item#1.1), and directed the Public Works Director
to prepare a contract change order for additional work to construct a left turn lane on Tice Valley
Boulevard through the median island fronting the Saranap Filling Station. The Board of
Supervisors also directed Public Works staff to return with a determination item recommending
the amount each party-should pay for this work and the rationale for splitting the costs.
A. Design Alternatives:
Public Works staff reviewed the sketch proposal offered by Mr. Abrams, traffic engineer
representing the Saranap Filling Station owner. When placed on "to scale" plans, (see attached
Alternative Plan C) Mr. Abrams' proposal requires an abrupt shifting of lanes. From a traffic
safety standpoint this is not desirable, especially near a busy intersection with bike lanes and
potential conflicts with traffic entering/exiting the filling station.
To address these problems Public Works staff reviewed two additional alternatives. The attached
Alternative Plan A extends the pavement widening and frontage improvement reconstruction an
additional 35 feet as compared to Mr. Abrams' proposal. This alternative results in an acceptable
traffic lane alignment, and is a noticeable improvement over Mr. Abrams' proposal.
The attached Alternative Plan B requires pavement widening and frontage improvements along
the Saranap Filling Station's Tice Valley Boulevard frontage and around the curb return at
Olympic Boulevard. It provides the same tangent traffic lane alignment that currently exists, and
was planned in the original project.
Based upon an extensive review of the alternatives and several discussions with the property
owner, the Department recommends Plan A. The additional right-of-way needed to construct this
alternative will have no adverse impact on Saranap Filling Station's present operations. It will not
require the relocation of their business sign and antique gas pump display, however, regardless
of which plan is constructed, the possible site obstructions that occur because of the existing
business sign/price billboard and gas pump display should be addressed.
B. Alternative Plan Costs:
The estimated costs for constructing each of the described alternative plans are attached. The
labor costs to effect this change are $7,800. The construction costs, including the utility re-
engineering cost and contingencies, vary from $7,400 for Alternative Plan C, $8,900 for the
recommended Alternative Plan A to $11,500 for Alternative Plan B.
C. Cost Sharing Recommendations:
During the original project design phase, staff spent significant time determining the best
alternative to provide the required pavement width on Tice Valley Boulevard, while considering
the close proximity of the two gas stations (Shell Oil on the southeast corner and Saranap Filling
Station on the southwest corner).
It was decided to purchase the Shell Oil station site in its entirety which resulted in no impact on
the Saranap Filling Station or the adjoining business property on the west side of Tice Valley
Boulevard. The total purchase price for the Shell Oil station may exceed $1,000,000 when the
issue of"goodwill" is settled with Shell Oil's tenant. Primarily due to the high cost of the right-of-
way, especially the non-federally reimbursable "goodwill" issue, this project is well over budget.
Any subsequent increases in project costs must be paid from County Road Funds, which are
already budgeted for other road projects.

We contend that our original project enhanced, not detracted from, the business prospects of the
Saranap Filling Station because of the Shell Oil gas station was removed. At one time there were
three gas stations at this intersection, now there is only one, the Saranap Filling Station. It could
be argued that the Saranap Filling Station (a private business) is the sole beneficiary of this left
tum lane which serves no general public interest. Therefore, the Saranap Filling Station owner
should pay all costs involved in constructing this left turn lane.
Based on the Board of Supervisor's actions on March 7, 1995, we believe the Board feels special
circumstances at this location warrant some.-financial participation by the County. Therefore, we
recommend the Saranap Filling Station owner pay 100% of the additional construction costs and
utility re-engineering costs for Alternative Plan A (estimated at $8,900). The County will pay
100% of the additional County labor costs involved in constructing Alternative Plan A which
includes design, engineering, preparing and negotiating a change order, right-of-way engineering,
title reports, preparing right-of-way dedication documents and contract administration.
We believe this cost sharing proposal is more than equitable considering that:
1) The original project provides access to the Saranap Filling Station (a sole business
enterprise) in the same manner as all other intersections with median islands within the
County.
2) The County's purchase of the Shell Oil gas station directly across the street eliminated the
Saranap Filling Station's nearest competition and enhanced business prospects without
the inclusion of this left turn lane.
3) The project costs, without this additional work, significantly exceed the original budget.
D. Road Improvement Agreement/Other Conditions:
Upon Board of Supervisor approval of Alternative Plan A and cost sharing arrangements, the
Saranap Filling Station owner shall perform the following to ensure this additional work is included
in the Olympic Boulevard Widening Project:
✓ Execute a Road Improvement Agreement by May 12, 1995, which commits the owner to
dedicate the necessary right-of-way (new right-of-way line located three feet behind back
of sidewalk), at no expense to the County, within one week of receiving dedication papers
from the County and agree to pay actual contract costs for constructing the left turn lane
in conformance with Alternative A.
✓ Deposit$8,900 with the County in conjunction with the execution of the Road Improvement
Agreement. This $8,900 represents the estimated additional construction costs for
Alternative Plan A, including the estimated re-engineering costs of utilities.
✓ Grant a right-of-entry, at no cost to the County, effective May 22, 1995, to allow the
contractor to begin work without delay.
IV. Consequences of Negative Action
If this Board Order is not approved, or if the Saranap Filling Station owner does not fulfill the
conditions stated above within the time frame given, the left turn lane into the Saranap Filling
Station will not be built.
