HomeMy WebLinkAboutMINUTES - 04251995 - 1.64 1 � .py THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on APRIL 25, 1995 by the following vote: AYES: Supervisors Rogers, Smith, DeSaulnier, Torlakson and Bishop NOES: None ABSENT: None ABSTAIN: None In the Matter of Correcting 1/1/95) Salary Levels for Non-Sworn Employees) Represented by Deputy Sheriffs' Association) Resolution No 951171 Section 5.1 (C) DSA Non-Sworn Salary Adiustment Formula of the 1991-1995 MOU between the County and the Deputy Sheriffs' Association provides that employees in non-sworn classifications in the bargaining unit receive salary increases in 1994 and 1995 equivalent to the average value of salary and benefit increases granted in those years to all bargaining units represented by Contra Costa County Employees Association, Local One, Social Services Union, SEIU, Local 535 (Rank & File) and United Clerical, Technical and Specialized Employees, AFSCME Local 2700; and The aforementioned "Formula" bargaining units received general salary increases on July 1, 1994 of one percent (10 Levels) and on January 1 , 1995 of one percent (10 Levels) and the same increases were extended on those dates to all non-sworn classes represented by DSA; and The County, at the request of the Deputy Sheriffs' Association, has recomputed the average value of all salary and benefit increases including special equity adjustments and benefits granted the formula bargaining units-on 7/1/94 and 7/1/95 and has determined that the average value for adjustments given on each date is 1 .06% and has executed the April 5, 1995 written agreement attached hereto as Exhibit 1 to further adjust salary levels for DSA non-sworn classes effective January 1 , 1995 by one level (.1%); NOW THEREFORE, The Contra Costa County Board of Supervisors in as capacity as governing Board of the County of Contra Costa and all districts of which it is the ex-officio governing Board RESOLVES THAT: Salary levels for non-sworn classifications represented by the Deputy Sheriffs' Association shall be set as indicated effective January 1 , 1995; Classification Class Code Schedule/ Level Criminalistics Laboratory Aide 6D713 C5-1525 Fingerprint Examiner I 64WB C3-1797 Fingerprint Examiner 11 64VG C5-2000 Fingerprint Technician I 64WJ C3-1493 Fingerprint Technician 11 64VH C5-1659 Lead Fingerprint Examiner 64HB C5-2071 Lead Fingerprint Technician 64HC C5-1732 Sheriffs Aide 64VF C5-1574 Sheriffs Ranger 64WR C5-1493 Sheriffs Specialist 64VE C5-1759 Sheriffs Dispatcher I 64WK C3-1 713 Sheriffs Dispatcher If 64WM C5-1853 Supervising Sheriffs Dispatcher 64HD C5-1993 Lump-Sum Payment. In lieu of a retroactive pay requiring special payroll recomputation processing back to January 1 , 1995, the County will make a lump-sum payment to each employee for the months of January, February, March and April 1995 computed as follows: Employee regular pay, overtime pay, overtime pay and specific other earnings ordinarily computed as a percentage of base pay will be added together for each applicable pay period to determine the appropriate pay base. This base will then be multiplied by one-tenth percent (.1%) to arrive at the employee's lump- sum payment. The payment amount thus computed will be added to the employee's June 10, 1995 paycheck where it will be listed separately as a "LUMP-SUM PAYMENT" and will be subject to normal tax withholding and retirement deduction requirements. California 94553-1292 Sr''-coii•:i April 5, 1995 Carl Carey, Field Representative Clisham and Sorter - Attorneys at Law 900 North Point Street, Suite 300 San Francisco, California 94109 RE: AGREEMENT TO APPLY DSA NON-SWORN SALARY FORMULA AS CUMULATIVE Dear Carl: This letter is to formally confirm agreement between the County and the Deputy Sheriffs' Association that Section 5.1 (C) DSA Non-Sworn Salary Adjustment' Formula in the 1991 - 1995 Memorandum of Agreement will be interpreted and applied as requiring the addition of a one level (.1%) salary adjustment for all non-sworn classifications in the Deputy Sheriffs Unit effective January 1 , 1995. This agreement is based upon our mutual investigation of the salary and benefit increases granted to CCCEA Local No. One, AFSCME Local 2700 and SEIU Local 535 on July 1 , 1994 and January 1 , 1995 and our conclusion that the approximate average value of those increases was 1 .06% on July 1 , 1994 and 1 .06% on January 1 , 1995. In view of the fact that the County's Salary Schedule is operative only at a level of _1%, we have agreed in the spirit and intent of Section 5.1 (C) to combine the fractional values of .06% for July and January into a .1% amount effective January 1 , 1995. We have agreed that this action will fully meet the County's obligations under Section 5.1 (C). With DSA's written concurrence below, I will prepare a Resolution for action in April by the Board of Supen/isors adjusting salaries for the non-sworn classes by one level effective January 1 , 1995. As in past situations where retroactive adjustment was necessary, i will seek authority to place the increase "on-line" effective May 1 , 1995 and direct the Auditor-Controller to compute a lump sum payment in lieu of retroactive pay for the months of January, February, March and April, to be included in the June 10, 1995 pay warrants.
