We have been informed that we need a letter from the County Board of Supervisors before the license application can be processed. per the form we received (original is enclosed herewith). We feel that because of the number of new homes which have been constructed in,the area, (both behind and across from the Cypress Shopping Center), a convenience store at this location is desirable. There are no convenience stores close by. In today's busy life, if Mom just needs milk or bread, she has to go to a Supermarket and stand in line -- or if a traveller wants a pack of cigarettes or a can of soda in the hot summer, supermarket lines can be inconvenient. For all, a convenience store is the answer. For traffic going toward Brentwood, there is no convenience store after Sandy Lane. The closest convenience store is 2 miles away for travelers and for homeowners/tenants, and people who might like to walk to a store. Now I would like to tell you something about our plans. We are planning to open a small (600 sq. ft.) convenience store called "Cigarettes 4 Less". It will be located in the Cypress Shopping Center, 2053 Main Street, Oakley. We will sell beer and wine, but not hard liquor, and we have no plans to add hard liquor at any time in the future. Our small store will carry mostly convenience items. We will run our business professionally -- that is, neat and clean, and will make every effort to keep our customers happy with good service which will make them come to our store often. We will make it a practice that before our employees are allowed to work behind the cash register, they will be thoroughly trained to know and obey all Alcoholic Beverage Control laws. As part of this, we will send- them for training with the Alcoholic Beverage Control Department. For your information, I have recently completed training with the ABC (photo-copy of certificate enclosed). In brief, I can assure you we will comply with all ABC regulations regarding the sale of alcohol. I would really appreciate your prompt issuance of the letter we need so we can submit it to ABC so they can process our application in a timely manner. For purposes of this portion of Section 23958, "law enforcement problem", means that applicant premises for an original or premises to premises transfer of any retail license located in an area where the following condition exists: (1) The applicant premises are located in a crime reporting district that has a 20% greater number of reported crimes in a geographical area within the boundaries of a single governmental entity (city or the unincorporated area of a county) than the average number of reported crimes as determined from all crime reporting districts within the jurisdiction of the local law enforcement agency that are identified by the local law enforcement agency in the compilation and maintenance of statistical information on reported crimes and arrests. (2) Lue Concentration is statutorily declared to exist when an original application or a premises-to-premises application is made for: a) A retail on-sale license in a census tract where the ratio of existing on-sale retail licenses to population in the census tract exceeds or will exceed the ratio of retail on-sale licenses to population in the county of the proposed premises: or b A retail off-sale license in a census tract where the ratio of existing off-sale retail censes to population in the census tract exceeds the ratio of retail off-sale license to population in the county of the proposed premises. Notwithstanding Section 23958, the Department may issue a retail license in an area deemed to be a high crime area by the local law enforcement agency or in an area that has an over concentration of retail licenses, if the local governing body (City Council or. County Board of Supervisors) of the area in which the applicant premises are located determines that public convenience or necessity would be served by the issuance. w APPLICANT INSTRUCTIONS Before your application for your retail license can be processed you are required to submit to the Department an official letter (documentation) showing that ublic convenience or necessity would be served from the local governing bo y, ity Council, County Board of ` Supervisors or tie designated representative of the jurisdiction in which your proposed premises is located.FTe letter from the governing body must specifically request issuance of the applied for license and explain how public convenience and necessity would be served.
