Detailed amendments showing deletions and insertions are attached. BACKGROUND: Changes to the bylaws were undertaken for several reasons: Department Head Responsibilities(New subsection 8.6-5(1)): Adds to Department Head Responsibilities the charge of identifying and approving off-site sources for patient care not provided at the hospital. Termination of Staff Membership Due to Inactivity (Section 5.8): Allows termination if no activity during initial appointment instead of waiting until fust reappointment period to be completed. Rights of the Practitioner(Section 6.8-4): Brings this section into compliance with state law and with other,previously approved,sections of the Bylaws. These changes were approved by the Medical Executive Committee on March 20,1995,and also by the active Medical Staff by mailed ballots. They also were reviewed by County Counsel. FISCAL IWACT: None. Tremain, M.D. SUPERVISORS AND COUNTY ADMINISTRATOR BY OA-)DEPUTY 8.6-5 Duties Each Department Head shall have the following authority,duties and responsibilities: Assess and recommend to the relevant hospital authority off-site sources for needed patient care services not provided by the department or organization. 5.8 TERMINATION OF STAFF MEMBERSHIP DUE TO INACTIVITY A member who,during the entire period of the latest appointment has been completely inactive in the staff, as defined in Section 5.6-1(c), shall be deemed to have voluntarily resigned from the staff. Such resignation shall result in automatic termination of membership, privileges, and prerogatives. A member whose membership is automatically terminated in accord with this section shall be entitled to the procedural rights provided in Article Al for the sole purpose of determining whether he/she had patient contacts or not. In such situation,the burden of proof shall be on the member and not on the Medical Staff. A request for Medical Staff membership subsequently received from a member so terminated shall be submitted and processed in the manner specified for the applications for initial appointments. 6.84 Rights of the Practitioner A practitioner shall not be entitled to the procedural rights afforded by Article XII because his/her request for temporary privileges is refused orbecause However, if all or any portion of his/her temporary privileges are terminated or suspended,the practitioner shall be entitled to the procedural rights afforded by Article XII.
