RECOMMENDATIONS
Adopt resolution in support of Assembly Bill 1720, introduced by
Assemblyman Tom Hannigan, which would create a corridor passenger
rail committee to oversee development of both intercity and
commuter rail services in the Capitol Corridor.
FISCAL IMPACT
None . The remaining $225, 000 balance in the Contra Costa Commuter
Rail Program PVEA Grant funds would be reprogrammed to support
activities of the new Capitol Corridor Committee which would be
created by this legislation.
BACKGROUND/REASONS FOR RECOMMENDATIONS
Assemblyman Tom Hannigan (8th District, Fairfield) has introduced
Assembly Bill 1720 to improve the planning and implementation of
passenger rail service in the Capitol Corridor. The Capitol
Corridor is an intercity passenger rail route extending 153 miles
from Roseville to San Jose . There are currently three (3) round
trips operating between Sacramento and San Jose, with station stops
in Martinez and Richmond. Long range service plans call for
expanding the service up to ten (10) round trips .

BACKGROUND/REASONS FOR RECOMMENDATIONS (continued)
A.B. 1720 involves the a re-structuring of the existing ACR-132
Capitol Corridor Policy Advisory Committee from an advisory body
into an inter-regional committee to plan and oversee development of
an integrated passenger rail service program in the 153 mile
Capitol Corridor. A copy of the bill is attached as Exhibit "A" .
The main mission of the Capitol Corridor Committee would be to plan
future passenger rail service that will address the needs of both
intercity and commuter travellers . The Capitol Corridor Committee
would initially be a fourteen member body made up of elected
officials appointed by the Congestion Management Agencies from each
of the seven counties in the corridor, including Contra Costa
County, and various state and regional transportation agency
representatives .
A.B. 1720 would subsume the commuter rail planning activities of
the Greater East Bay Rail Opportunities Coalition into the new
corridor committee and the remaining balance of Contra Costa County
Petroleum Violation Escrow Account (PVEA) Grant Funds would be
transferred to support the activities of the corridor committee .
Adoption of this legislation would also involve the eventual
dissolution of the Joint Powers Agreement creating the Greater East
Bay Rail Opportunities Coalition.
The Transportation Committee has reviewed this draft legislation
and recommends the Board of Supervisors adopt the attached
resolution in support (attached as Exhibit "B" ) . It is noted that
the Board of Supervisors gave conceptual support for the Hannigan
legislation at its December 19, 1994 meeting, but requested that
the Transportation Committee report back to the Board of
Supervisors with a specific recommendation once a bill was
introduced in the 1995 legislative session.

An act to add Article 5 (commencing with Section 14070)
to Chapter 1 of Part 5 of Division 3 of Title 2 of the
Government Code, relating to transportation.
LEGISLATIVE COUNSEL'S DIGEST
AB 1720, as introduced, Hannigan. Intercity rail service:
Capitol Corridor.
(1) Under existing law, the Capitol Corridor intercity rail
service is operated between Roseville-Sacramento-Oakland
under the sponsorship of the Department of transportation.
This bill would create the Capitol Corridor Committee,
specify the membership of the committee, and prescribe its
functions and responsibilities.
The bill would require the committee to submit reports
each 6 months to the California Transportation Commission
and the Legislature on the status of passenger rail planning
and implementation in the Capitol Corridor.
The bill would impose a state-mandated local program by
- ' requiring the Metropolitan Transportation Commission to
provide staffing for the Capitol Corridor Committee.
(2) The California Constitution requires the state to
reimburse local agencies and school districts for certain costs
mandated by the state. Statutory provisions establish
procedures for making that -reimbursement, including the

RESOLUTION NO. 95/168
The Board of Supervisors of Contra Costa County RESOLVES THAT:
WHEREAS, a new state-sponsored intercity rail service operated by AMTRAK, known as the
CAP/TOL ROUTE, was introduced on December 12, 1991 with an initial three daily round trips
between Sacramento, Suisun/Fairfield, Martinez, Richmond, Emeryville, Oakland,and San Jose,and
then extended service to Auburn;
WHEREAS, the development of intercity passenger rail service between the Bay Area and
the Sacramento Metropolitan Area along the heavily congested Interstate 80 freeway corridor has
been identified as a high priority in federal, state and regional planning studies;
WHEREAS, a study completed in November 1990 by the Metropolitan Transportation
Commission under Assembly Concurrent Resolution 132, in cooperation with the Sacramento Area
Council of Governments; which recommended a three staged program to phase-in up to ten round
trip trains in the corridor by the Year 2000, is now being used by the Department of Transportation
as the framework to implement intercity train service in the corridor (referred to as the ACR-132
Intercity Rail Upgrade Study);
WHEREAS, the Policy Advisory Committee for the ACR-132 Study has been retained to
continue providing the California Department of Transportation with local input and guidance for
the CAP/TOL ROUTE.
WHEREAS, the mission of the Greater East Bay Rail Opportunities Coalition, a joint powers
board composed of the Board of Supervisors and Congestion Management Agencies for Alameda,
Contra Costa, and Solano counties and the Metropolitan Transportation Commission, was to
evaluate potential opportunities to use the East Bay's existing network of railroad rights-of-way
for commuter rail transit paralleling congested highway travel corridors, and to conduct such
studies and analysis, as necessary, to determine the viability of such rail transit services;
WHEREAS, the Greater East Bay Rail Opportunities Coalition has completed a Commute Rail
Operating Plan which identifies a framework for implementing a commuter rail service parallel to
Interstate 80, also known as the CAPITOL CORRIDOR;
WHEREAS, fiscal realities in 1995 are such that the region cannot afford to implement a
new, dedicated commuter rail service paralleling the Interstate 80 corridor, as described in the
Commute Rail Operating Plan;
NOW, THEREFORE BE IT RESOLVED that the Contra Costa County Board of Supervisors
strongly supports a continued public commitment toward providing intercity passenger rail service
between the Bay Area and the Sacramento Metropolitan Area consistent with the recommendations
in the ACR-132 Intercity Rail Corridor Upgrade Study.
RESOLVED, that the Contra Costa County Board of Supervisors hereby supports the
Assembly Bill 1720, introduced by Assemblyman Tom Hannigan (8th Dist.), to create a CAPITOL
CORRIDOR COMMITTEE with responsibility for planning and advancing the development of
passenger rail in the corridor, including the eventual introduction of commuter rail service when
patronage levels and funding make such service viable.
RESOLUTION NO. 951168
BE IT FURTHER RESOLVED, the Contra Costa County Board of Supervisors hereby
recognizes that should Assembly Bill 1720 become law this will mean the eventual dissolution of
the Joint Exercise of Powers Agreement creating the Greater East Bay Rail Opportunities Coalition
and that all activities associated with passenger rail development in the corridor, both intercity and
commuter services, will reside within the newly created CAPITOL CORRIDOR COMMITTEE. It is
also acknowledged that this legislation would mean transferring the remaining balance of Contra
Costa County's Petroleum Violation Escrow Account (PVEA) grant funds (Contra Costa Commuter
Rail Program) to support activities of the new CAPITOL CORRIDOR COMMITTEE.
