YANCEY, District Attorney j Costa n; ;S County DATE: March 29 , 1995 SUBJECT: Approval for Submission and Execution of Contract With the State Office of Criminal Justice Planning for Funding of Contra Costa DA-NET (Major Narcotic Vendor Prosecution Program) For the Period July 1, 1995 to June 30, 1996 SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION I. RECOMMENDED ACTION Authorize the District Attorney to submit an application and execute a grant award contract and any extensions or amendments thereof, with the State Office of Criminal Justice Planning for funding of Contra Costa DA-NET (Major Narcotic Vendor Prosecution Program) for the period July 1 , 1995 through June 30 , 1996, in the amount of $123 , 631 (state funds - budgeted) . II . FINANCIAL IMPACT This grant application is in the amount of $123 ,631 to fund salaries and benefits for an attorney and an investigator for the project. The District Attorney' s Office has operated its DA-NET project for six ( 6) years. The State has made it clear that award of funding is contingent on the State budget, and that even if approved the project' s funding could decrease or be eliminated, depending on the State budget and the State' s revenue situation throughout the fiscal year. Nonetheless, as in prior years, revenue will be built into the District Attorney' s 1995/96 budget to implement the grant. III . REASONS FOR RECOMMENDATION/,BACKGROUND The goal of the State program is to enhance prosecution of major drug vendors through vertical prosecution, thereby increasing the likelihood of convicting offenders and ensuring appropriate sentences for their crimes. Chapter 1424, Statutes of 1984, thorized the State program and set forth its basic guidelines. The Law Enforcement Western States Information Network estimates that Contra Costa along with Sacramento County, are the most active methamphetamine manufacturing areas in Northern California. This grant has allowed Contra Costa County to assign a skilled and committed team to pursue these time-consuming and complicated cases. The results for the first six months of fiscal 1994/95 were: 16 new defendants referred to DA-NET were filed upon, 25 defendants pled guilty in Superior Court while 5 other defendants chose jury trials which all ended in convictions. IV. CONSEQUENCES OF NEGATIVE ACTION Failure to approve this recommendation would result in the inability of the District Attorney to apply for $123 ,631 in State funds available to combat major narcotics production and trafficking in the County. Since these funds will be built into the District Attorney' s 1995/96 budget, disapproval of the recommendation would create a revenue shortfall of that amount. THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on April 11, 1995 , by the following vote: AYES: Supervisors Rogers, Smith, DeSaulnier, Torlakson, Bishop NOES: None ABSENT: None ABSTAIN: None SUBJECT: Major Narcotic Vendor Prosecution (MNVP) Program, Contra Costa DA-NET RESOLUTION OF THE GOVERNING BOARD 95/ 157 WHEREAS the Board of Supervisors, Contra Costa County, desires to undertake a certain project designated CONTRA COSTA DA-NET, to be funded in part from funds made available through the Major Narcotic Vendor Prosecution (MNVP) Program administered by the Office of Criminal Justice Planning (hereinafter referred to as OCJP) . NOW, THEREFORE, BE IT RESOLVED that the District Attorney of the County of Contra Costa is authorized, on its behalf, to submit the proposal to OCJP and is authorized to execute, on behalf of the Board of Supervisors,, the Grant Award Agreement, including any extensions or amendments thereof. IT IS AGREED that any liability arising out of the performance of this Grant Award Agreement, including civil court actions or damages, shall be the responsibility of the grant recipient and the authorized agency. The State of California and OCJP disclaim responsibility for any such liability. BE IT FURTHER RESOLVED that grant funds received hereunder shall not be used to supplant expenditures controlled by this body.
