REVIEW THE MERITS OF A PROPOSAL FOR BAD CHECK RESTITUTION

RECOMMENDED ACTION: Refer to the Finance Committee and the District Attorney to
review the merits of a proposal to provide Bad Check Restitution Service to Contra Costa County.
BACKGROUND INFORMATION: Reference the attached correspondence from Computer
Support Services.
Many small businesses have a difficult time collecting on bad checks. To the degree Contra Costa
County can assist in this.area, I believe this would be an important service to our business community.

Dear Mr. Torlakson:
Thank you for your interest in the "D.A. LAW" Bad Check Restitution Service. l must apologize
for the delay in mailing this information to you, but the year end disbursement reports to the
various counties and the merchants consumed a major portion of my time this week.
We are currently providing the Restitution Service to Colusa, EI Dorado, Madera, Mendocino,
Modoc, Napa, San Francisco, Siskiyou, Trinity and Tehama Counties. Butte, Santa Barbara and
Ventura counties are using our software system on-site.
I have enclosed an article that appeared in the F.B. 1. Law Enforcement Bulletin about our
system, a brochure describing the system options, samples of letters received from both
merchants and check writers and various news articles about the program. Also, I am enclosing
a sample of what a merchant (victim) receives initially when they decide to enter the program.
All materials and services are provided by this office at no charge to the victims or the taxpayers,
and the county receives 30% of the gross fees (administrative and diversion). We have the
capability of reporting to a joint county task force as you mentioned concerning Contra Costa and
Alameda counties sharing the prosecution and investigative staff. We currently report to four
jurisdictions in Mendocino County.
For the year just ended, we have generated the following results for San Francisco County:

Victims reporting 5,551
Checks reported 9,468 $451,662.00
Checks Recovered 3,415 $182,789.00
Fees Generated $ 61,209.00
Out of the 9,488 checks received, 2,632 were old (stale)which gave an effective recovery rate of
49.8% for the first year of operation. our goal is at least 70%this coming year. With the
intermittent news coverage and other publicity methods utilized, we will be able to accomplish
this.

I have also enclosed a list of a few victims that you could contact for their opinion about our
j service and how it has performed for them.
