RECQMAMNDED ACTION: Adopt the attached resolution in support of Assembly Bill 1019, as proposed by Assemblyman Richard Rainey. BACKG►ROM INFORMATION: Contra Costa County, along with the Cities of Antioch and Brentwood, has entered into a Joint Powers Agency in order to design and construct the State Route 4 Bypass in East Contra Costa. In addition,the County has imposed regional building permit fees for new construction to provide a portion of the funding for this key regional route. However, funds derived from building permits will not be sufficient to cover the total cost of the project. Assembly Hill 1019 will allow counties and cities to enter into joint exercise of powers authorities that will allow the construction, management, and operation of toll road facilties, thereby providing an additional funding source. It is a bad deal for the County, because it places the County at great financial risk while at the same time enriching a private toll road consortium (The California Toll Road Company), which includes the Bank of Paris and Westpac Banking Corporation of Australia. AB 1019 should be opposed for the following reasons: • Public funds could be used to underwrite the speculative profits of a private company AB 1019 allows the creation of a Joint Powers Authority within the existing franchise zone controlled by the California Toll Road Company (CIRC). Therefore, the JPA is nothing more than a thinly veiled funding mechanism for the toll road company. Since the company has a contract to build all roads within the zone (see map), it would hold all the cards in negotiations with the JPA. . The toll road company could demand pay for past work, compensation for potential unrealized future profits, and an exclusive road construction contract. & Local jurisdictions would assume the financial risk - not the toll road company This legislation appears designed to protect the Toll Road Company from all risks, while giving it access to the public purse. The risks of financing a potential facility would be assumed by the Joint Powers Authority, not the toll road company, while the State of California would continue to provide liability coverage. By issuing bonds, a Joint Powers Authority would be speculating on whether enough traffic and development could be generated to recoup the investment. 9 County bond ratings would be put at risk In light of the recent Orange County bond fiasco, does it make sense for a Joint Power Authority to put local governments' bond ratings at risk by funding speculative toll road projects? Price Waterhouse has described such projects as "likely to face significantly greater business, financial, and policy risks than entities that have traditionally been regulated on a cost-of-service basis, such as electric, water, and gas utilities." (Price Waterhouse letter to Carl Williams, September 4, 1990). Previous estimates have put a price tag on the toll road of two to eight billion dollars. Even if only a part of it is built, can Contra Costa County handle a default on a billion dollar bond issue? The results are predictable: increased air pollution, increased traffic congestion and a lowered quality of life. • N built, the tollroad,will create gridlock on Highway 4 Building out eastern Contra Costa County to pay for a toll road would cause traffic to far exceed the capacity of Highway 4 -even if there were sufficient funds to widen Highway 4, which there are not. Two years ago Contra Costa County passed a resolution in opposition to the toll road because it was a bad idea. The current proposal is for the same road with different window dressing. If the bill is passed, local jurisdictions will assume all the risk while the private toll road company is guaranteed the profits, whether or not a road is built.
