SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMMENDATION: Issue order tolling the time for review of FCC Form 1205s submitted by TCI Cablevision systems and Viacom Cable systems for an additional ninety (90) days . FINANCIAL IMPACT: None. BACKGROUND: Pursuant to the rules adopted to implement rate regulations by the Federal Communications Committee (FCC) , TCI Cablevision systems (Walnut Creek, Brentwood and Contra Costa) and Viacom Cable systems (Pinole and Pittsburg) submitted FCC Form 1205 to update regulated equipment and installation charges based on 1994 calendar year costs . Under the FCC rules, the County has a period of 30 days to review and act upon the Form 1205 (FCC Rules 76 . 922 (d) ( 3) and 76 . 933(a) ) . If the review cannot be completed in that time, the time for review may be extended an additional ninety (90) days (FCC Rule 76 . 933(b) ) . Since the rates from the Form 1205 are on top of previously submitted Form 1205 (submitted with baseline Form 1200) and those rates are currently being reviewed-, staff will not be able to complete review of the newly submitted Form 1205s within the initial 30 day time period.
