HomeMy WebLinkAboutMINUTES - 03211995 - 1.66 1.65 thru 1.67 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on March 21,1995, by the following vote: AYES: Supervisors Rogers, Smith, DeSaulnier, Torlakson and Bishop NOES: None ABSENT: None ABSTAIN: None SUBJECT: Correspondence Item No. 1.65 LETTERS received March 7, 1995, from Superintendents of the Oakley Union Elementary School District, Byron Union School District, and the Liberty Union High School District requesting that the Board not approve new residential development proposals until agreement has been reached between the Districts, the County, and the building industry on the financing of school facilities. "REFERRED TO DIRECTOR, GROWTH MANAGEMENT AND ECONOMIC DEVELOPMENT AGENCY 1.66 RESOLUTION adopted by the Board of Supervisors, Colusa County,requesting support for a moratorium on the regulatory action of the U. S. Fish and Wildlife Service, pending a .Congressional review of the activities of the Agency. Sincerely, Kathleen Moran County Clerk and Ex-Officio Clerk to the Board of Superysors-d by 4� �Z(A Yolanda Tirado Deputy Clerk RESOLUTION NO. 95-13 A RESOLUTION OF THE COLUSA COUNTY BOARD OF SUPERVISORS IN SUPPORT OF AN IMMEDIATE MORATORIUM ON THE REGULATORY ACTIONS OF THE U.S. FISH AND WILDLIFE SERVICE WHEREAS, Congress on July 4, 1776 unanimously adopted the Declaration of Independence which states "that all men are created equal, that they are endowed by their Creator with certain unalienable rights, that among these are life, liberty and the pursuit of happiness" ; and WHEREAS, the Declaration of Independence further states that "to secure these rights, governments are instituted among men, deriving their just powers from the consent of the governed" ; and "That, whenever any form of government becomes destructive to these ends, it is the right of the people to alter or to abolish it, and to institute a new government" that will affect the safety and happiness of the people; and WHEREAS, the government was formed "of, by and for the people" ; and WHEREAS, the people of the United States have adopted a Constitution that enumerates and guarantees these rights; and WHEREAS, the U. S. Fish and Wildlife Service has violated these Constitutional rights and property rights that are held within the Constitution and have purposely attempted to circumvent the intent of Congress in regard to the National Biological Survey in California as well as in other states within the union, and WHEREAS, the Biological Opinion in regard to CVP renewal of three year interim contracts violates/undermines these rights through oppressive regulatory demands; thus we, the people do hereby demand that, An immediate moratorium be instituted against all U. S. Fish and Wildlife activities and all USF&W funds for regulatory actions be frozen, until such time as Congress has reviewed USF&W activities as they relate to the rights and freedoms of the people of the United States . Specifically, these activities include designation of critical habitat, issuing of Biological Opinions, surveying and assessment of private property for the presence and habitat of endangered, threatened and candidate species . Resolution passed and adopted this 28th day of February, 1995 by the following vote: AYES: Supervisors Nathanael L. McCoy, David G. Womble and W.D. Mills. NOES: Supervisor William R. Waite.
