Offer of Dedication
(S. & H. C. § 8335)
SUBJECT: Termination ofOfferofDedicationtoSatisfyConditionsofApproval-Subdivision7163,
W.O. 1838, Oakley CP NO. 95-10.
The Board of Supervisors of Contra Costa County RESOLVES THAT:
This Termination of an Offer of Dedication of a certain excess right of way not required for
road purposes is made pursuant to Government Code Section 66477.2(c) and to Division 9, Part 3,
Chapter 4 of the Streets and Highways Code, commencing with Section 8330.
This termination request is for an Offer of Dedication of an excess road right of way located
in the Oakley area. A description and plat map of the offered area to be terminated are attached
hereto as Exhibit "A" and Exhibit "B" and incorporated herein by reference.
This termination request is based on the fact that the street or highway has been superseded
by relocation (S. & H. Code Section 8330).
Considering all facts before it, this Board FINDS there is no reasonable probability that the
County will accept the offered roadway into the County road system, and that it is in the best interest
of the County and the public that the offered area be privately owned and maintained.

Termination of Offer of Dedication To Satisfy
Conditions of Approval - Subdivision 7163, Oakley Area.
This Board hereby FINDS that the proposed termination will not have a significant effect on
the environment, and that it has been determined to be exempt from the California Environmental
Quality Act under State CEQA guidelines Section 15061(b)(3). This Board DIRECTS the Director
of Community Development to file a Notice of Exemption with the County Clerk, and DIRECTS the
Public Works Director to arrange for payment of the $25.00 handling -fee to the County Clerk.
This Board hereby TERMINATES the hereinabove described offer of dedication to satisfy
conditions of approval and ABANDONS the right of the County to accept said offer.
The Real Property Division is ORDERED to record a certified copy of this Resolution in the
office of the County Recorder.
From and after the date this resolution is recorded,the offer of dedication to satisfy conditions
of approval is terminated and the County's right to accept offer is abandoned.

a portion of the northeast quarter of Section 25, Township 2 North,Range 2 East, Mount
Diablo Meridian, described as follows:
All of PARCEL A and all of PARCEL B dedicated to Contra Costa County for roadway,
access, and utilities by Subdivision 7163 "Claremont Bay"filed October 5, 1990, in Book
352 of Maps at page 13.
RESERVING THEREFROM: Pursuant to the provisions of Section 8340 of the Streets and
Highways Code, the easement and right at any time, or from time to time, to construct,
enlarge, maintain, operate, replace, remove, and renew those existing and in place
utilities, as of the date of recording this instrument, in, upon, over, and across any highway
or part thereof proposed to be terminated including access to protect the property from all
hazards, in, upon, and over the area herein before described to be terminated.

This activity is not subject to the California Environmental Quality Act (CEQA) pursuant to
Article 5, Section 15061 (b) (3) of the CEQA Guidelines.
It can be seen with certainty that there is no possibility that the activity may have a significant adverse
effect on the environment.
DESCRIPTION OF THE ACTIVITY: The purpose of the activity is to vacate the County's
interest in the temporary access road from Cypress Road to Bayview Drive to satisfy the Conditions
of Approval for Subdivision 7163 (see Figures 1-3). The temporary access road consists of Parcel
A (APN 035-730-051), measuring approximately 3,800 sq. ft. and Parcel B (APN 035-730-052),
measuring approximately 11,250 sq. ft. The Conditions of Approval state that the temporary access
road shall be closed off and ultimately vacated or cul-de-saced when alternate public road access is
provided to the development from Cypress Road. Public road access from Cypress Road to the
development is provided from Waterford Way, thus the temporary access road is no longer needed.
LOCATION: Subdivision 7163 is located in the Oakley area of east Contra Costa County. The
parcels are located between Bayview Drive and Cypress Road.
