SUBJECT: Amendment to Agreement to Provide Services to Delta Diablo Sanitation District

SPECIFIC REQUEST(S)OR RECOMMEND I ATION(S)&BACKGROUND AND JUSTIFICATION
1. Recommended Action: APPROVE Amendment to agreement to provide right of way services
to Delta Diablo Sanitation District for their Pittsburg Conveyance System project and AUTHORIZE
the Board Chair to sign said amendment on behalf of the County.
If. Financial Impact: Delta Diablo Sanitation District will pay the actual costs for Real Property
staff right of way services.
Ill. Background and Reasons for Recommendations: Delta Diablo Sanitation District requires a
variety of right of way services but has no right of way staff and desires to contract with the
County for these services.
IV. Consequences of Negative Action: Less efficient government because Delta Diablo Sanitation
District would have to hire additional private contractors at greater expense.

AMENDMENT TO AGREEMENT BETWEEN COUNTY OF
CONTRA COSTA AND DELTA DIABLO SANITATION DISTRICT
1. Effective Date and Parties. Effective on January 4, 1995, COUNTY OF CONTRA
COSTA, (herein called "County"), a political subdivision of the State of California, and the
DELTA DIABLO SANITATION DISTRICT, a municipal corporation (herein called
"District"), mutually agree as follows:
2. Purpose. The parties desire to amend the Agreement they entered into, effective February
15, 1994, for appraisal, review, negotiation, land rights document preparation, and right of
way acquisition services to add to the scope of work.
3. AMENDMENTS:
a. Section 4, sentence 4 is amended to read as follows:
"Total cost to District for County's services shall not exceed $30,500 without the
written approval of the District."
b. Task 1 and Task 2 in Appendix "A" of the agreement are deleted in their entirety and
replaced with the following:
"Task 1: Negotiations with owners of seven parcels, including reviews by senior
staff, as necessary. Costs for this task shall be itemized separately in invoices to the
District. Cost for this task not to exceed $20,400.
Task 2: General Consultation with District Staff(up to 32 hours). Budget for this
task is $2,200."
4. Effect. Except for the amendment agreed to herein, said Agreement remains unmodified and
in full force and effect.
