SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
I. Recommended Action:
A. APPROVE Right of Way Contract and ACCEPT Grant Deed dated January 13, 1995, from John
& Pauline Papini.
B. AUTHORIZE Chief Engineer to execute said Right of Way Contract on behalf of the District.
C. APPROVE-payment of$165,000 for said property rights and AUTHORIZE the Auditor-Controller
to transfer $132,000 from the Park Dedication Trust Fund, 8136, Account No. 271130201, to
Public Works Account No. 7557 and issue a check in the amount of$165,000 payable to Chicago
Title Company, Walnut Creek, CA., Escrow No. 076461 to be forwarded to the Real Property
Division for delivery.

D. DIRECT the Real Property Division to have the above referenced Grant Deed recorded in the
office of the County Recorder.
II. Financial Impact:
Payment of $165,000 from 80% Park Dedication Trust Funds and 20% from DA30A funds.
III. Reasons for Recommendations and Background:
These property rights are required for the Laurel Detention Basin/Ballfield project in accordance
with approved plans and specifications.
IV. Consequences of Negative Action:
The project will not have sufficient land rights to allow construction in accordance with the
approved plans and specifications.

A portion of that parcel of land described in the deed to John Papini et ux recorded June 23, 1993
in Book 18680 of Official Records at page 103, records of Contra Costa County, California, described
as follows:
Beginning at the southeast corner of Parcel 1613 as described in the deed to Contra Costa County
Flood Control and Water Conservation District recorded November 15, 1990 in Book 16246 of
Official Records at page 813; thence from the Point of Beginning, northerly along the east line of said
Parcel 1613 (16246 O.R. 813), to the north line of said Papini parcel (18680 O.R. 103); thence,
leaving the east line of Parcel 1613, easterly along the north line of said Papini parcel (18680 O.R.
103), to a point on a line which is parallel with and 168.54 feet easterly of the east line of said Parcel
1613 (16246 O.R. 813); thence leaving the north line of said Papini parcel (18680 O.R. 103),
southerly along last said parallel line, to a point on the south line of said Papini parcel (18680 O.R.
103); thence leaving said parallel line, westerly along the south line of said Papini parcel, said south
line is also the north R/W line of Laurel Road, to the Point of Beginning.
Containing an area of 2.5 acres of land, more or less.
Bearings are based on the California Coordinate System Zone III (CCS27).
EXCEPTING THEREFROM all oil, oil rights, minerals, mineral rights, natural gas, natural gas rights,
and other hydrocarbons by whatsoever name known that may be within or under the parcel of land
hereinabove described, together with the perpetual right of drilling, mining, exploring and operating
therefor and removing the same from said land or any other land, including the right to whipstock or
directionally drill and mine from lands other than those hereinabove described, oil or gas wells,
tunnels and shafts into, through or across the subsurface of the land hereinabove described, and to
bottom such whipstock or directionally drilled wells, tunnels and shafts under and beneath or beyond
the exterior limits thereof, and to redrill, retunnel, equip, maintain, repair, deepen and operate any
