Yancey, District Attorney .DATE: .Tune 17, 1994 SUBJECT: Approval For Submission and Execution of Contract With the State of California Department of Insurance, for the Purpose of Combatting Workers Compensation Fraud for the Period of July 1, 1994 through June 30, 1995 SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION Z _ RECOMMENDED ACT=ON Authorize the District Attorney to submit an application and execute a grant award contract, including any extensions and amendments thereto, with the State of California Department of Insurance for funding of the prosecution of Workers ' Compensation Fraud for the period July 1, 1994 through June 30, 1995, in the amount of $277,228. __ _ F=NANC IAL IMPACT None. The grant application in the amount $277,228 will fund the salary and benefits for an attorney, one-half clerk, and one ( 1) senior inspector assigned to the program. Supplantation is prohibited. Expenditures and revenue for these positions are included in the District Attorney' s proposed budget for 1994/95. ___ _ REASONS FOR RECOMMENDAT=ON/BACKGROUND The Legislature has determined that Workers' Compensation insurance fraud is a major contributor to the high cost of doing business in this state. The cost of . Workers' Compensation to employers has almost doubled to $10 billion in less than ten years. SB1218 (Presley) was enacted to put teeth into the law and resources into enforcement to tackle the growing problem of Workers ' Compensation insurance fraud. If the grant is approved, it will allow the District Attorney to place specially trained staff in our Criminal Fraud Division who will be able to concentrate on the growing problem of insurance fraud. aV _ CONSEQUENCE S OF NEGAT 2VE ACT 2ON Failure to approve this recommendation would result in the inability of the District Attorney to apply for $277,228 in state funds designated for use by Contra Costa County in the prosecution of Workers ' Compensation insurance fraud. Any county which fails to submit their application shall not be considered for funding, a their undistributed funds shall be returned to the Department of urance fund to be reprogrammed. NOW, THEREFORE, BE IT RESOLVED that the District Attorney of Contra Costa County is authorized to execute on behalf of the Board of Supervisors the Grant Award Agreement including any extensions or amendments thereof. ITIS AGREED that any liability arising out of the performance of this Grant Award Agreement, including civil court actions for damages, shall be the responsibility of the grant recipient and authorizing agency. The State of California and the California Department of Insurance disclaim any responsibility for such liability. BE IT FURTHER RESOLVED that the grant funds received hereunder shall not be used to supplant expenditures controlled by this body.
