SUBJECT: TOLL THE TIME FOR REVIEW OF BASIC CABLE RATES SUBMITTED
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATION:
ISSUE order tolling the time for review of basic cable television
services and related equipment rates submitted by the cable
operators for an additional ninety ( 90) days .
FINANCIAL IMPACT:
Preliminary review of rates can be done by staff . If additional
review is needed costs have been estimated at $5, 000 per cable
system. Staff will attempt to work with cities to reduce costs by
joint review of cable systems .
BACKGROUND:
As authorized by the Cable Television Consumer Protection and
Competition Act of 1992 ( 1992 Cable Act) , Contra Costa County
applied for and was certified to regulate basic cable service and
related equipment rates effective October 27 , 1993 .
An amendment was adopted to the County' s Cable Television Ordinance
No. 93-55 on April 26, 1994 to include provisions for enforcement
of federal rate regulations for basic service.
Following the adoption of this amendment, cable operators were
notified that the County was certified to regulate basic service
charges and had adopted the appropriate regulations to do so.
Cable operators were asked to submit FCC Form 393 .

Due to revisions in the Federal Communication Commission's (FCC)
rate regulations, cable operators were given until June 15, 1994 to
respond to requests for FCC Form 393 from local jurisdictions . Bay
Cablevision, Century Cable, Concord TV Cable, TCI Cablevision of
Contra Costa County, TCI Cablevision of East County, TCI
Cablevision of Walnut Creek, Viacom Cable (Pinole system) and
Viacom Cable (Bay Point) have submitted their FCC Form 393 ' s for
review by the County.
In order to review the rate submissions of all cable systems,
additional time is need for review and is authorized by the FCC
regulations in Section 76 . 933, which states that the franchising
authority may toll the deadline for review by ninety ( 90) days in
cases not involving cost-of service showings . Rates can not be
reviewed or rolled back and are approved thirty days after
submission of the FCC Form 393 to the County unless this action is
taken. Staff therefore recommends that the Board toll the deadline
to allow opportunity for the necessary review.
