CONSIDER ACTION ON KELLER CANYON LANDFILL RATE AND
SUBJECT: CONSIDERATION OF ACTIONS ON ALAMEDA COUNTY'S LANDFILL
PROPOSAL FOR CONTRA COSTA WASTE
SPECIFIC REQUEST(S)OR RECOMMENDATIONS)A BACKGROUND AND JUSTIFICATION
RECOMMENDED ACTION:
1 ) In preparation for more detailed discussions on the Keller
Canyon Landfill rate for June 28 as scheduled by the Board of
Supervisors last Tuesday, consider action to allow Browning-Ferris,
Inc/Keller Canyon Landfill to negotiate lower rates immediately and to
be prepared to present specific proposals by June 28 .
2 ) Direct County Counsel to complete their legal analysis of
the mitigation fees included in the Keller Land Use Permit and report
to the Board of Supervisors no later. than June 28 regarding the
feasibility of adjusting fees in a manner that will sustain the
appropriate level of mitigation cash flow while not diminishing the
overall commitment embodied in the original fees established.
3 ) Direct the County Administrator and County Counsel to
review recent actions taken in Alameda County regarding Altamont
Landfill and the disposal of Contra Costa waste.
BACKGROUND INFORMATION: Ever since the Board of Supervisors ,
original vote setting rates at Keller (which I did not support) , there,
have been continuing questions about how to accomplish lower rates .
Two major changes have occurred since that time changing circumstances
that existed when rates were originally set. First, a Supreme Court
decision opened the doors for garbage to move out of one county into
other counties . Second, the direction of the State Integrated
Waste Management Board to have each county develop and use its own
landfill for disposal has somewhat changed. The current approach is
much more hands off, laissez-faire, "let the market place" determine
disposal directions and decisions . Our Board has been seeking ways
to lower the rates within the context of these new circumstances .

After discussion by the Board of Supervisors on the above matter, and on
recommendation by Supervisor Torlakson, IT IS BY THE BOARD ORDERED that
recommendations 1 , 2 , and 3 are APPROVED. In connection with recommendation
No. 1 , REMOVED the floor on any proprietary rates that were previously approved
by the Board in order to dispose of waste at the Keller Landfill (The
proprietary portion of the rate for the Keller Landfill .and appropriate
[Acme], transfer station ) so that the rate can be adjusted downward based on
competative market situations . In addition on recommendation No. 3 , County
Counsel is REQUESTED to investigate the issue of the legality of an out-of-
County surcharge on solid waste.

Last Tuesday, the Board unanimously supported Supervisor Jeff
Smith' s proposal to schedule on our June 28th agenda the subject of
landfill rates and setting lower rates . For months, county staff,
along with staff from several cities and other public entities have
been in negotiations with BFI and Acme Fill regarding significant
reductions in the landfill tipping costs and overall rate.
One guiding principal for these discussions should be that any
proposed contracts or commitment of wastestream to KCLF should provide
a guarantee that Keller would provide the lowest rate possible for
Contra Costa County consumers .
Furthermore, in consideration of the action Alameda county has
taken regarding Contra Costa waste, an analysis of its impacts is
needed--especially regarding environmental concerns, traffic impacts,
and potential loss of revenue for Contra Costa County which would
instead go to Alameda County.
