SUBJECT: HIGHWAY 4 WIDENING/PHASE III - OAKLEY AREA

SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
I. Recommended Action:
A. APPROVE Right of Way Contract and ACCEPT Grant Deed dated May 12, 1994 from
Conco Land Company.
B. AUTHORIZE Public Works Director to execute said Right of Way Contract on behalf of
the County.
C. APPROVE payment of $1,000 for said property rights and AUTHORIZE the Auditor-
Controller to issue a check in said amount payable to Conco Land Company, 5151 Port
Chicago Hwy, Concord, Ca., 94520, to be forwarded to the Real Property Division for
delivery.
D. DIRECT the Real Property Division to have the above referenced Grant Deed recorded
in the office of the County Recorder.
Il. Financiallmpact:
Payment of $1,000 from Oakley Area of Benefit funds.
III. Reasons for Recommendations and Background:
These property rights are required for the Highway 4 widening project in accordance with the
approved plans and specifications.
IV. Consequences of Negative Action:
The project will not have sufficient land rights to allow construction in accordance with the
approved plans and specifications.

hereby GRANT to CONTRA COSTA COUNTY, a political subdivision of the State of
California, all that real property in the County of Contra Costa, State of California,
FOR DESCRIPTION SEE EXHIBIT "A" ATTACHED HERETO AND MADE A PART
HEREOF.
The grantor further understands that the present intention of the grantee is to construct
and maintain a public highway on the lands hereby conveyed in fee and the grantor, for
itself, its successors and assigns, hereby waives any claims for any and all damages to
grantor's remaining property contiguous to the property hereby conveyed by reason of
the location, construction, landscaping or maintenance of said highway.

A portion of the unincorporated area of Contra Costa County, State of California being a portion of
Parcel C as shown on the map of Subdivision 5500 filed November 12, 1980 in Book 247 of maps
at page 28 records of said County described as follows:
Commencing at the northwest corner of said Parcel C; thence leaving said point of commencement
along the northerly line of said parcel south 89007'02" east 306.06 feet to the true point of beginning
for the herein described parcel, said point of beginning also being a point which shall hereinafter
be referred to as Point "A"; thence leaving said Point of Beginning continuing south 89007'02" east
16.00 feet to the beginning of a tangent curve concave to the southwest having a radius of 10.00
feet; thence along the arc of said curve through a central angle of 90°01'56", an arc length of 15.71

RELINQUISHMENT OF ABUTTER'S RIGHTS
The Grantor hereby releases and relinquishes any and all abutter's rights of access appurtenant to
State Highway 4 along the portion of the hereinbefore described PARCEL NUMBER 52243-1 being
a line connecting Points "A", "B", "C" and "D".
Bearings and distances are based on the California Coordinate System Zone III (CCS 27). Multiply
given distances by 1.00006296 to obtain ground distances.
