Project No.: 4500-6X5244 SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION I. Recommended Action: 1. ACCEPT Engineer's Report for Countywide Landscaping District(LL-2) Fiscal Year 1994- 95, for formations, annexations, and annual assessments; 2. ADOPT Resolution initiating formation and annexation proceedings and identifying improvements to be maintained and serviced in the following proposed zones in the District: 41, 42, 43, 45, 46, 47, 48, 49 and 50; and APPROVE attached "Notice A" to be sent to property owners in said zones pursuant to Board Ordinance No. 79-43, Article 1012-2 608(b) and required by Senate Bill 1977 (Bergeson); 3. ADOPT Resolution initiating annexation proceedings to include commercial property in the following zones in the District: 9, 16, 20, 21, 36, 37 and 38; and APPROVE attached "Notice B" to be sent to each property owner in said zones pursuant to Board Ordinance No. 79-43, Article 1012-2 608(b) and required by Senate Bill 1977 (Bergeson); it 4. CONCUR with the Chief Engineer's determination regarding parcels to be added to the assessment rolls for the following zones in the District: 7, 9;..15, 16, 19, 20, 21, 23, 25, 36, 37, 38, and 41; and DIRECT the Chief Engineer to send the attached "Notice C" to all of the property owners being assessed for the first time in all previously established (existing) zones. SET July 19, 1994, at 11:00 a.m. in the Board Chambers as the time and place for a Public Hearing on the proposed formations, annexations and annual assessments for Countywide Landscape District (LL-2); 6. SET July 26, 1994, at 11:00 a.m. in the Board Chambers as the time and place for a Public Hearing on the proposed formations and annexations, and the adoption of the proposed annual assessments for Countywide Landscaping District(LL-2);and CONFIRM reportordering improvements and levying annual assessments and AUTHORIZE that they be collected on the tax roll; 7. DIRECT the Clerk of the Board of Supervisors to complete the required pubic notification (Section 6061 Government Code) in a newspaper of general circulation at least ten days before the hearing. 8. DETERMINE that the activity is not a project subject to the California Environmental Quality Act Pursuant to Sec. 15061(133), Categorical Exemption; DIRECT the Director of Community Development to file a Notice of Exemption with the County Clerk; and DIRECT the Public Works Director to arrange for payment of the $25.00 handling fee to the County Clerk for filing of the Notice of Exemption; and 9. APPROVE the change in name from the Landscaping and Lighting District AD 1979-3 (LL-2) to Countywide Landscaping District (LL-2). II. Financial lmpact: Implementation of the proposed Countywide Landscape District (LL-2) Assessments for Fiscal Year 1994-95 will raise approximately $1,200,000. These funds will be used solely on maintenance work in the forty-three zones. III. Reasons for Recommendations and Background: The proposed formations of Zones 41, 42, 43, 45, 46, 47, 48, 49 and 50 are to implement a requirement in the Conditions of Approval for new subdivisions which require inclusion of the of the subdivision area in Countywide Landscape District (LL-2) for the purpose of establishing funding for maintaining and servicing the landscape and irrigation facilities constructed as part of the subdivision. Significant landscaping and park improvements have been installed within the various communities of the District, it is appropriate that the commercial properties in Zones 9, 16, 20, 21, 36, 37, and 38 now be added to the assessment rolls so that they also participate in funding the maintenance and service costs. The County has separate landscape and street light programs. Changing the name from the Lighting and Landscape District AD 1973-2 (LL-2) to Countywide Landscaping District(LL-2) will reduce confusion with County . Service Area L-100. County Service Area L-100 is the Countywide Street Lighting Program. IV. Consequences of Negative Action: Funds will not be available to maintain the landscaping and other improvements in the zones. The Conditions of Approval for your subdivision require that certain landscaping,irrigation,and/or other facilities be installed,and that a financial mechanism be established to provide perpetual maintenance. Your developer requested annexation to the District as the means of providing this mechanism. , The estimated assessment proposed for your parcel for Fiscal Year 199495 is shown in the upper right hand comer of this notice.
