Adopted this Order on June 28 , 1994 , by the following vote:
AYES: Supervisors Powers, Smith, Bishop, DeSaulnier

SUBJECT : Hearing On Appeal By city of Martinez, The Friends of
Franklin Hills and the East Bay Regional Park District
Relative to LUP 2054-93, Smart SMR of California, Inc.
And Ramon a M. Schumann, Martinez Area .
This is the time heretofore noticed by the Clerk of the
Board of Supervisors for hearing on the appeal by the city of
Martinez, The Friends of the Franklin Hills and the East Bay
Regional Park District from the decision of the contra Costa
County Planning Commission to uphold the Zoning Administrator' s
approval of the request by Smart SMR of California, Inc.
(applicant) and Ramona M. Schumann (owner) to establish a
telecommunications facility in a General Agricultural Zoning
District (A-2 ) (LUP 2054-93) . Said facility would include a 200
square foot equipment shelter and a 70 foot high antenna support
structure with a combined support/antenna height of 84 feet in
the Martinez area .
Dennis Barry, Community Development Department, presented
the staff report, commenting on conditions added by the Planning
Commission adding a condition to Condition No . 11, that the
painting of the structure reflect less than fifty percent of the
light that hits it . Mr . Barry presented the staff
recommendations .
The public hearing was opened and the following persons
presented testimony:

representing the applicant;

Cathy Nowicki, 610 Main Street, Martinez;
Sharon Hicks, 334 Arreba, Martinez;
Barbara J. Woodburn, 621 Brackmore Lane, Martinez;
Joseph P. Brenke, 396 Cummings Skyway, Martinez;
David r . Fischer, P.O. Box 1997 , Martinez;
Dom MacPhee, 1140 Panoramic Drive, Martinez;
Peter Bluhon, 261 Purdue Avenue, Kensington;
Sherida Bush, 843 Pinon Drive, Martinez;
Bob Doyle,Assistant General Manager, Land Acquisition, East
Bay Regional Park District;
Ted Radke, representing the Board of East Bay Regional Park
District;
Alice Alderette, 1425 Shell Avenue, Martinez;
Mr. Hasseltine spoke in rebuttal .
On recommendation of Supervisor Smith, IT IS BY THE BOARD
ORDERED that the hearing on the above matter is CONTINUED to July
12, 1994, in the Board chambers; and the matter is REFERRED to
the Community Development Department to address concerns raised
today, and develop an alternative to address the concerns and to
develop findings to support the alternative .
