BRAGDON °' a ^` County DIRECTOR OF COMMUNITY DEVELOPMENT y� ' b DATE: June 16, 1994 sra`cour--- SUBJECT: Continued Further Hearings on Rezoning with Preliminary Development Plans 2992-RZ and 2993-RZ, and Development Agreements Proposed by Windemere and Shapell Industries in the Dougherty Valley Area SPECIFIC REQUEST(S) OR RECOMMENDATIONS) & BACKGROUND AND JUSTIFICATION RECOMMENDATIONS Continue indefinitely the decisions on the rezonings with preliminary development plans and development agreements. FISCAL IMPACT None. BACKGROUND/REASONS FOR RECOMMENDATIONS In May of 1994 a tentative decision was received in the Douhe Valley lawsuit brought by the East Bay Municipal Utility Dist ict. The Court found that the Environmental Impact Report for the DVSP and GPA was inadequate because it failed to adequately address the issue of water supply for the Dougherty Valley. The decision on the Town of Danville, et al. lawsuit is still pending. In light of the recent Court action, staff recommends these matters be continued indefinitely. At the time they are considered again, the items will be renoticed appropriately for public hearing.
