SUBJECT: APPROVE $.80 PER TON REDUCTION IN AB 939 TIP FEE
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS
Approve reducing the AB 939 Tip Fee by $.80 (eighty cents) per ton
effective July 1, 1994 as requested by City Council resolutions
from the cities in Central and East County; and,
Direct the Community Development Director, or his designee, to
advise the Keller Canyon Landfill Company, Browning Ferris
Industries, and Acme Fill Corporation that the AB 939 Tip Fee is to
be reduced from $.95 (ninety-five cents) per ton to $. 15 (fifteen
cents) per ton effective July 1, 1994 and to continue payment of
the $. 15 per ton AB 939 Tip Fee to the County Community Development
Department.
FISCAL IMPACT
None to the County General Fund. The current $. 95 per ton AB 939
Tip Fee provided funding for the County and cities in Central and
East County for AB 939 planning. Based upon a formula agreed to
between the Central and East County cities and the County,
established in 1991, $.80 of the AB 939 Tip Fee has been returned
to the cities. This $.80 is the amount now being reduced in the
Tip Fee.
BACKGROUND/REASONS FOR RECOMMENDATIONS
Under AB 939 cities and counties may establish tip fees to fund
both planning and implementation of solid waste management
programs, facilities, and activities. The local AB 939 Tip Fee was
set at $.95 per ton.
In 1991 an- agreement was reached to share the local AB 939 Tip Fee
between the County and the cities in Central and East County; the
West County cities chosee to fund directly their own AB 939
planning activities.

The County's $. 15 per ton AB 939 Tip Fee was to fund preparation of
the Countywide Integrated Waste Management Plan, staffing of the
Countywide AB 939 Local Task Force, and coordination of solid waste
planning with the State. These activities cost the County over
$750,000.
Cities' costs to prepare Source Reduction and Recycling Elements
and other solid waste management plan requirements were funded by
each city. Each city received a portion of the $.80 per ton AB 939
Tip Fee to fund its planning.
In December, 1993, all Central and East County cities and the
County received State approval of their Source Reduction and
Recycling Elements, Household Hazardous Waste Elements, and Non
Disposal Facilities Elements. Moreover, in December, 1993, the
State approved the Countywide Integrated Waste Management Plan.
These approvals completed the first mandated plans for local solid
waste management; excepting any needed amendments to local plans or
the Countywide Plan, jurisdictions within Contra Costa now have 5
years until updated solid waste management plans will be necessary.
With the completion of this planning the Central and East County
cities are requesting elimination of that portion of the AB 939 Tip
Fee which funded their solid waste management planning activities.
City Council Resolutions requesting the Board to eliminate the
cities' portion of the AB 939 Tip Fee have been received from
Pittsburg, Concord, San Ramon, Danville, Lafayette, Moraga, and
Orinda; Antioch is scheduled to approve its resolution on June 28th
and Walnut Creek is scheduling action on its resolution at the end
of July. Pleasant Hill, Martinez, and Clayton have not yet
scheduled action on this matter.
