As requested by the Secretary, Reclamation District No.
2026, Webb Tract, IT IS BY THE BOARD ORDERED that John Winther,
Robert Korslin, and David Forkel are APPOINTED Election
Commissioners for the July 21, 1994, Special District Election.

Re : Special Election for Reclamation District 2026
Reclamation District No. 2026, in connection with . the District' s
proposed issuance of time warrants, voted to authorize a special .
election by .mail to be held on July 21, 1994 to determine whether
the District may issue time warrants that are tobe paid over a
period of twenty years . Copies of these Resolutions are enclosed.
The District requests that your Board appoint three commissioners
to administer the election under the terms of the Reclamation
District Law. As -stated inthe two-page Resolution, the proposed
Election Commissioners are David Forkel, John Winther and Robert
Korslin.

RECLAMATION DISTRICT NO. 2026
WHEREAS, by Resolution adopted on June 9, 1994 , the Board of
Trustees of Reclamation District No. 2026 authorized an election
to determine whether the District shall issue time warrants;
WHEREAS, Elections Code Section 1340 allows any special election
to held wholly by mail under certain conditions;
WHEREAS, the proposed date of the election on the issuance of
time warrants does not fall on the date of any statewide primary
or general election;
WHEREAS, there are less than 1, 000 voters eligible to participate
in the election on the issuance of time warrants; and,
WHEREAS, it is the desire of the Board of Trustees to minimize
the cost of the special election on the issuance of time
warrants;
NOW, THEREFORE, BE IT RESOLVED:
1 . The Board of Trustees of Reclamation District No. 2026
hereby authorizes the use of mailed ballots in the
election on issuance of time warrants, to be held on
July 21, 1994 .

I, David A. Forkel, Secretary of the above District, do
hereby certify that the above is a true and correct copy of the
Resolution duly adopted by the Board of Trustees of Reclamation
District No. 2026 on June 9, 1994 .

RECLAMATION DISTRICT NO. 2026
WHEREAS, Reclamation District No. 2026 currently has outstanding
approximately $ 5 million in demand warrants;
WHEREAS, Reclamation District No. 2026 wishes to retire these
outstanding warrants in a timely fashion without, however,
placing an undue burden on the owners of lands located within the
District;
WHEREAS, the holder (s) of the District' s outstanding demand
warrants. are willing to exchange those warrants for time warrants
to be paid from future operation and maintenance assessment
calls; and
WHEREAS, the time warrants required to retire the outstanding
demand warrants will be in an amount in excess of $ 5 per acre
and will be issued over a period exceeding 5 years;
NOW, THEREFORE, BE IT RESOLVED:
1 . The issuance of the proposed time warrants is in the best
interests of the District .
2 . The Board of Trustees of Reclamation District No. 2026
authorizes a special election, pursuant to the provisions of
Water Code Section 53042 . 5, to determine whether the
District shall issue time warrants . The election shall be
held on July 21, 1994 .
3 . The special election shall allow the landowners in the
District to determine whether the District shall issue time
warrants with a total principal amount of $ 4 million,
bearing interest at 7% per annum, to be paid semi-annually
out of operation and maintenance assessment calls over a
period not to exceed 20 years .
4 . The Board of Trustees requests the Contra Costa County Board
of Supervisors to appoint, as Election Commissioners, the
following individuals, each of whom is a landowner or a
legal representative of a landowner in the District :
David A. Forkel, whose mailing address is : 3697 Mount Diablo
Boulevard, Suite 320, Lafayette, California 94549, will
serve as the Inspector of the election.
John Winther, whose mailing address is also 3697 Mount
Diablo Boulevard, Suite 320, Lafayette, California 94549,
will serve as a Judge of the election.

Robert Korslin, whose mailing address is : 3470 Mount Diablo
Boulevard, Lafayette, California 94549, will serve as a
Judge of the election.
5 . The Board of Trustees authorizes payment of the Election
Commissioners at the rate of $0 per day.
6 . The Board of Trustees appoints as a Counting Board the
Election Commissioners and Kay Festersen. The Counting
Board shall be compensated at a rate of $0 per day.
7 . The Board of Trustees directs the District' s staff to take
all other actions necessary to conduct this election in
accordance with State law.
