Richard Heyne, Employee Relations' Manager, and Henry Clarke, General Manager, Contra Costa County Employees' Association, Local 1, and Al Prince, Administrative Service Officer, Community Services Department, regarding a one- time only lump sum payment to employees in the Child Development Representation Unit. Box 222 Martinez, CA 94553 Dear Ms. Mueller: This side letter memorializes agreement between the parties for a one-time-only, lump sum, cost of living payment to eligible permanent and temporary project employees in the Child Development and Preschool Programs of the Community Services Department for the period of July 1, 1993, through June 30, 1994 . It is understood and agreed by the parties that this one-time-only lump sum cost of living payment in no way sets a precedent for the allocation of monies in future fiscal contract years between the State of California and the Contra Costa County Community Services Department. Lump sum cost of living payments will be made to eligible employees in accordance with the following criteria: 1. Eligibility is based solely on employment earning history 'in the 1993-94' Child Development, Title IV-A and Preschool programs for the period of July 1, 1993, through June 30, 1994 . 2 . The amount of lump sum, cost of living payment for each eligible employee will be calculated by first dividing an employee's July 1, 1993, through June 30, 1994, employment earnings by the total Child Development, Title IV-A and Preschool payroll for the above referenced time period to arrive at a percent, not to exceed. two percent (2%) . For purposes of illustration only, the following formula is shown: TOTAL EMPLOYEE GROSS PAY : TOTAL C.D.D. PAYROLL = PERCENT (%) 3. The percentage derived by the formula shown in paragraph two (2) above will then be multiplied by the net balance of unexpended/unobligated funds remaining in the 1993-94 Child Development/Title IV-A and Preschool contract budgets . All 1993-94 contract, expenditures and encumbrances will be liquidated first before the net balance of unexpended/ unobligated funds is determined. The payment amount computed will be issued as soon as possible by the County Auditor-Controller, shown on an employee's regular 10th of the month pay check as a Lump Sum payment, subject to normal tax withholding deduction requirements. Any employee believing there is an underpayment resulting from the payment methodology described above may contact the Community Services Department's Personnel Officer to request a review of her/ his lump sum payment. Upon such a request, the Auditor-Controller's Office will investigate and issue any additional pay, if owed, as soon as possible.
