Subsequent authorization to proceed with the general plan amendment study does not imply County approval of the proposal. FISCAL IMPACT: The applicant will pay a general plan amendment fee. BACKGROUND/REASONSBACKGROUND/REASONS FOR RECOMMENDATION Shapell Industries has requested the`B6ard'of Supervisors to authorize a general plan'amendment study for the Gale Ranch portion of the Dougherty Valley area. The general plan amendment proposes to change the County General Plan Land Use map and other County General Plan Elements to accommodate up to 1,216 residential units in an area which is presently designated as Agricultural Lands. The Gale Ranch is presently within the service area of the East Bay Municipal Utility District and other service areas for needed urban services to ultimately support proposed development. In late 1992, the County Board of Supervisors certified an environmental impact report for subsequent approvals of general plan amendment and specific plan to accommodate up to 11,000 housing units in the larger Dougherty Valley area. Based on those initial approvals, Shapell Industries was processing the needed land development entitlements for the first residential project under the previous Dougherty Valley approvals. Gale Ranch is located within the East Bay Municipal Utility bistrict Service Boundary. The proposed general plan amendment study would only cover the 618 acre portion identified on Figure 1. The applicant's request is based on the recent court ruling on the Dougherty Valley Specific Plan and General Plan Amendment. If the Board of Supervisors authorizes the general plan amendment study, staff would collect the appropriate fees and integrate the environmental review for the general plan amendment with the entitlements which Shapell Industries has submitted to the County for processing. Bragdon Planning Director Contra Costa County Community Development Dept. 651 Pine Street, 4th Flr.,No. Wing Martinez, CA 94553 Country Club at Gale Ranch General Plan Amendment Our File No. 72272-004 Dear Mr. Bragdon: On behalf of Shapell Industries;I�submit this request that you recommend that the Contra Costa County Board of Supervisors authorize a General Plan study for Shapell's proposed "Country Club at Gale Ranch" development. The Dougherty Valley, of which the Country Club at Gale Ranch is a part, is the subject of litigation challenging the County's approvals of a General Plan amendment and Specific Plan•for the entire Dougherty Valley and certification of the accompanying environmental impact report. A recent superior court ruling calls into question these actions as they relate to the provision.of Nater to those portions of the Dougherty Valley that are not currently within the service boundaries of a water provider. Country Club at Gale Ranch is within the existing service boundaries of the East Bay Municipal Utility District. Therefore, although we expect a successful resolution to the issues identified by the court involving the remainder of the Dougherty Valley, we would like to proceed with the Country Club at Gale Ranch at this time in a manner that reflects its unique situation with regard to water service. Shapell Industries currently has complete applications on file with the County for. a rezoning, preliminary development plan, final development plan, and vesting tentative subdivision map for the Country Club at Gale Ranch. By this letter, we request a General Plan amendment for the Country Club at Gale Ranch area that would contemplate development as indicated in these applications. Upon the Board's authorization to proceed with a General Plan Mr. Harvey E. Bragdon June 7, 1994 Page 2 study, we would work with staff to more definitively determine the appropriate General Plan classifications for such a General Plan amendment.
