Martinez, Executive Director cc: SUBJECT: CASA DEL RIO SENIOR HOUSING DEVELOPMENT: RESOLUTION NO.3711 AUTHORIZING THE TRANSFER OF PORTIONS OF THE PROPERTY TO THE CITY OF ANTIOCH FOR USE AS PUBLIC SIDEWALKS I. RECOMMENDED ACTION ADOPT Resolution No. 3711 AUTHORIZING the Housing Authority to grant and dedicate the four corners of the Casa del Rio property in Antioch to the City of Antioch for use as public sidewalks; and AUTHORIZING the Executive Director of the Housing Authority to execute a grant deed to transfer those portions of Housing Authority owned property to the City of Antioch for said use. H. FINANCIAL IMPACT: No General Funds required. The Housing Authority will transfer these corners of the property to the City of Antioch, at no cost, with the understanding that the City of Antioch will be responsible for liability and maintenance of the public sidewalk areas located at each corner. III. REASONS FOR RECOMMENDATION/BACKGROUND The Housing Authority has completed the construction of Casa del Rio, the senior housing complex which encompasses a full city block in the City of Antioch. During construction of Casa del Rio,the City of Antioch required the Housing Authority to construct larger curb returns at each corner of the block. As part of constructing these larger curb returns, it was necessary to construct new sidewalk areas which extended onto the Housing Authority's property at each of those corners. Because these new sidewalks areas form part of the public sidewalk, the City has requested that these corners be deeded to the City. Once the Grant Deed for the four corners is recorded,the City will assume responsibility for liability and maintenance of the sidewalk areas built on the four corners. At its regular meeting on June 20, 1994, the Advisory Housing Commission recommended that the Board of Commissioners approve the Resolution. IV. CONSEQUENCE OF NEGATIVE ACTION: A decision by the Board of Commissioners not to approve the Resolution would mean that the Housing Authority would be responsible for liability and maintenance of these public sidewalk areas, while the rest of the sidewalks surrounding Casa del Rio would be the City's responsibility. That the Board of Commissioners of the Housing Authority of the County of Contra Costa authorize the Housing Authority to grant and dedicate to the City of Antioch that certain real property, described in the attached Exhibit A, for public sidewalks . 2 . That the Executive Director of the Housing Authority be authorized to execute that certain Grant Deed, to be dated June 21, 1994, as is necessary to carry out this resolution and in which the Housing Authority of the County of Contra Costa is the Grantor and the City of Antioch is the Grantee. 3 . That this Resolution shall take effect immediately.
