SPECIFIC REQUEST(S)OR RECOMMENDATION(S)& BACKGROUND AND JUSTIFICATION
I. Recommended Action:
A. APPROVE Right of Way Contract and ACCEPT Grant Deed dated June 1, 1994, from
Charles F. and Mary E. Butera.
B. AUTHORIZE Public Works Director to execute said Right of Way Contract on behalf of the
County.
C. APPROVE payment for said property rights and AUTHORIZE the Auditor-Controller to issue
a check for$250.00 payable to Charles F. Butera and Mary E. Butera, 52501/2 Sunset Drive,
EI Sobrante, California 94803, to be forwarded to the Real Property Division for delivery.
D. DIRECT the Real Property Division to have the above-referenced Grant Deed recorded in the
Office of the County Recorder.
II. Financiallmpact:
Payment totalling $250.00 which is 89% reimbursable from Federal Aid funds and 11% reimbursable
form EI Sobrante AOB funds.
III. Reasons for Recommendations and Background:
These property rights are required for the Appian Way Triangle project in accordance with approved
plans and specifications.

A portion of Lot 248, San Pablo Rancho, in an unincorporated area of Contra Costa County,
California, being also a portion of that parcel of land designated as "BUTERA" on the Record of
Survey filed January 19, 1968 in Book 50 of Licensed Surveyors' Maps at page 26, records of said
County, described as follows:
Commencing on the southeast right of way line of Sobrante Avenue at the most western corner of
PARCEL B (50 LSM 26); thence along said right of way line, south 40039'35" west 76.01 feet to the
Point of Beginning; thence from the Point of Beginning southwesterly along the arc of a tangent
curve concave to the east having a radius of 20.00 feet, through a central angle of 18045'35" a
distance of 6.55 feet; thence leaving the southeast right of way line of Sobrante Avenue, non-
tangent to said curve, south 55031'20" east 2.96 feet; thence north 40039'35" east 6.11 feet; thence
north 49020'25" west 4.00 feet to the Point of Beginning.
Containing an area of 23 square feet of land, more or less.
Bearings and distances are based on the California Coordinate System Zone III (CCCS 27). Multiply
