HomeMy WebLinkAboutMINUTES - 06141994 - H.2 THE REDEVELOPMENT AGENCY OF CONTRA COSTA COUNTY Adopted this Order on June 14 , 1994 by the following vote: AYES: Commissioners Smith, De Saulnier, and- Bishop NOES: None ABSENT: Commissioners Powers and Torlakson ABSTAIN: None Resolution No. RA 94-1 ----------------------------------------------------------------- ----------------------------------------------------------------- SUBJECT: Designation of Specified Parcels in the North Richmond Redevelopment Project Area for Redevelopment as a Unified Development Area and Authorization to Distribute a Request for Proposals and to Complete Actions Necessary for Selection of a Master Developer for such Unified Development The Contra Costa County Redevelopment Agency RESOLVES THAT: By Ordinance No. 87-50 adopted July 14, 1987, the Board of Supervisors of,.the County of Contra Costa adopted the Redevelopment Plan for the North Richmond Redevelopment Project (the "Plan") establishing a program of redevelopment (the "Project") within the North Richmond Redevelopment Project Area (the "Project Area") . Pursuant to the California Community Redevelopment Law, the Redevelopment Agency of the County of Contra Costa (the "Agency") is responsible for implementing the Project. By Resolution No. 87-14, adopted on June 2, 1987, the Agency adopted Rules for Business Tenant Preference and Owner Participation in the Project Area (the "Rules") . Based on information and analysis set forth in the RFP (as defined below) on file with the Agency Secretary, the Agency has determined that it is in the best interest of the Project that certain parcels in the Project Area be developed by a single developer as a seniors housing development in the manner authorized by the Plan and Part III A of the Rules. A map showing the parcels- is attached to this Resolution as Exhibit A and is incorporated in this Resolution by this reference. The Plan and the Rules establish criteria for selection of a master developer for the parcels and provide for the solicitation of development proposals from eligible property owners and other interested prospective developers. Agency staff has prepared a Request for Proposals (the "RFP") in accordance with the Plan and the Rules, setting forth the selection criteria and soliciting qualifications for a master developer for the parcels. The RFP is on file with the Agency Secretary. The Agency hereby determines that it is in the best interest of the redevelopment of the Project Area to develop the parcels shown on Exhibit A as a unified seniors housing development in accordance with the provisions of the Plan and Part III A of the Rules, and hereby designates such parcels as a unified development area. FISCAL IMPACT These actions initiate a process that could result in development by a selected master developer of an approximately 50 unit seniors rental housing development . It is anticipated that that development may require local public financial assistance in an amount to be determined through negotiations . Any such financial assistance would be provided through County CDBG and/or Housing Trust Fund moneys earmarked and available for this purpose . Despite these blighting conditions, the Site has the potential, through reuse as a new affordable seniors rental housing development, to serve as the centerpiece for revitalization of the entire residential portion of the Project Area. To enable development of the envisioned seniors housing development requires assembly of the Site for unified development by a single master developer. The Redevelopment Plan for the North Richmond Redevelopment Project and the Agency' s Owner Participation Rules authorize the Agency to designate the Site as a unified development area for this purpose . It is' recommended that the Agency designate the Site as a unified development area and proceed with selection of a master developer through distribution of 'a request for proposals that has been prepared by staff . Staff would review all proposals received and return witha recommendation for selection of a master developer by the Agency Board in approximately 45 days . Staff and the selected master developer would then negotiate a redevelopment agreement for Agency Board approval . The owners of property within the Site have been notified that the Agency Board is considering designation of the Site as an unified development area. Pursuant to the. Redevelopment Plan and the Agency' s Owner Participation Rules, each property owner will be given the opportunity to submit a development proposal to serve as the master developer. Designation of the Site as unified development area and selection of a master. developer does not commit the Agency to provide assistance in the assembly of the Site. INTRODUCTION The Contra Costa County Redevelopment Agency (the "Agency") invites your proposal to serve as the Master Developer of certain property (the "Site") contained within the North Richmond Redevelopment Project Area (the "Project Area") as indicated on the attached map (Exhibit "A"). The Agency envisions the development by the Master Developer of a senior rental housing complex with potential complementary community and/or commercial facilities that will serve as the centerpiece for revitalization of the residential portion of the Project Area in accordance with the goals and objectives of the Redevelopment Plan for the North Richmond Redevelopment Project (the "Redevelopment Plan"). It. SITE AND LOCATION: NEED AND OPPORTUNITY FOR REDEVELOPMENT The Site consists of approximately 90,000 square feet of land comprising the majority of the block bounded by Second Street, Grove Avenue, Third Street, and Chesley Avenue in the Project Area. The Site contains 22 parcels that would be assembled through the efforts of the Master Developer, with Agency assistance as appropriate. At present, the Site is a major impediment to the redevelopment of the entire Project Area. It contains an incompatible mixture of residential and commercial parcels on undersized lots. Many of the parcels contain extremely dilapidated, and in some cases, burned-out structures. Many of the structures are abandoned and those that are occupied are generally substandard for their intended residential or commercial use. Because of the condition of the parcels comprising the Site, their inadequate size, and their multiple ownership, it is infeasible for individual property owners to redevelop their properties in the absence of any assurance that surrounding parcels will be simultaneously revitalized in a manner that will justify the separate investments of each individual property owner. While the current condition of the Site is poor, the Site is centrally located within the residential portion of the Project Area and enjoys excellent potential to serve as a focus of residential revitalization for the entire neighborhood. The objective of redeveloping the Site as a modem, attractive multifamily residential complex can be accomplished only through assembly of the Site for redevelopment as a unified whole. For these reasons, by resolution adopted on June 14, 1994 in accordance with the Redevelopment Plan and the Agency's Rules for Owner Participation, the Agency designated the Site as a unified development area to be redeveloped by the selected Master Developer with appropriate Agency assistance. III. PROPOSED DEVELOPMENT: ACHIEVEMENT OF REDEVELOPMENT GOALS AND OBJECTIVES The Agency seeks a Master Developer that will redevelop the Site as an approximately 50-unit seniors rental housing complex, with the potential for inclusion of complementary community facilities (such as a Center for Health and Sheriffs Annex) and/or commercial -1- facilities (such as a supermarket or other retail use) as jointly determined by the Agency and the selected Master Developer. The Agency envisions that the residential units would consist of appropriately sized and appointed one-bedroom units that would be made available at affordable rent to low and moderate income households, including very low income households, comprised of elderly persons. The envisioned development would eliminate the current blighting conditions of the Site described above, achieve goals and objectives of the Redevelopment Plan to increase the supply of quality affordable housing within the Project Area, and serve as the centerpiece of and catalyst for revitalization of the entire residential portion of the Project Area. IV. PROPOSED FINANCING: AGENCY ASSISTANCE The Agency seeks a Master Developer with the expertise and ability to design and implement a workable financing package for the proposed development, drawing upon available public and private funding sources for affordable seniors housing. As mentioned above, the Agency is prepared to cooperate in the assembly of the Site, but seeks a Master Developer that is capable of assembling as many of the needed parcels as possible on a voluntary basis. The Agency will consider the use of its power of eminent domain, if necessary, to assemble parcels within the Site. However, the Agency would use such power only upon a determination, in its sole policy discretion following conduct of all mandated legal procedures, that use of such power is necessary for effective redevelopment of the Site. Neither this Request for Proposals, the selection of a Master Developer, or the execution of an exclusive negotiating rights agreement with the selected master developer constitutes a commitment by the Agency to exercise its power of eminent domain to acquire or assemble any parcel within the Site. The Agency is also prepared to consider the provision of loan assistance to the extent necessary, after application of all other funding sources obtainable by the Master Developer, to meet the costs of land assembly and development. V. LAND USE DESIGNATION OF SITE A general plan amendment, rezoning, and development plan will be required to permit the use of the Site as envisioned by the Agency and described in this Request for Proposals. The Agency has initiated the County land use entitlement process to obtain the necessary general plan amendment and rezoning, and is prepared to cooperate with the selected Master Developer to complete that process. Granting of the necessary general plan amendment and rezoning will be subject to approval of the County Board of Supervisors in the exercise of its policy discretion following conduct of all mandated legal procedures. -2- VI. SELECTION AND NEGOTIATION PROCESS The responses to this Request for Proposals will be evaluated by the Agency staff in accordance with the selection criteria set forth below. The Agency staff will make a recommendation to the Redevelopment Agency Board of Directors after reviewing all submitted information and conducting background checks and oral interviews, as necessary. It is anticipated that the Agency staff will be prepared to make this recommendation to the Agency Board by August 2, 1994. Following selection, the Agency intends to negotiate a mutually agreeable program of redevelopment with the selected Master Developer. During the negotiations, Agency staff and the Master Developer will discuss all issues relevant to the development, including land price, condition of the property, relocation issues, development schedule, financing, marketing/management of the completed units, aesthetic considerations of the development, ongoing affordability controls, and level and forms of required Agency assistance. If such negotiations result in a mutually agreeable program of redevelopment, such program will be set forth in a Disposition, Development and Loan Agreement to be executed by the Agency and the Master Developer. This Agreement will set forth procedures and specific conditions for the proposed development and outline the specific terms and obligations of both the Agency and the Master Developer. The Agreement will also clearly indicate the timeframe for the development of this project. The Contra Costa County Redevelopment Agency has the sole authority to select a developer and reserves the right to reject any and all proposals. VII. SELECTION CRITERIA In soliciting proposals for this development, the Agency has established criteria for Master Developer selection which, in the Agency's determination, are appropriate to the size, scope, character and quality of the envisioned development. These selection criteria include the following: 1. The nature and quality of the proposed development in making a positive, high quality, aesthetically pleasing impact as an integral site in the Project Area; 2. The compatibility of the proposed development with other redevelopment projects planned in this immediate area; 3. The ability of the prospective developer to meet the goals and objectives of the Agency and the Redevelopment Plan; 4. The financial capability of the prospective developer to complete all aspects of the development, including the ability to design and implement a program for maximizing the use of other funding sources available for development of seniors housing. -3- I I ( r 5. The technical and professional quality of the prospective master development team, including architects, engineers, contractors, marketing consultants and others; 6. The record of experience of the prospective developer in completing other affordable housing developments of comparable size, scope and complexity; 7. The ability of the prospective developer to assemble as much of the Site as possible on a voluntary basis; 8. The prospective developer's commitment to quality design, as expressed by previous projects and the proposed design concepts for this development; and 9. Preference will be accorded to existing property owners (including those with options to purchase parcels within the Site), all other qualifications being equal. VIII. PROPOSAL CONTENTS All proposals should contain 2 COPIES of the following information in order to allow the Agency staff to evaluate each proposal on an equal basis. PLEASE SUBMIT MATERIALS IN KEEPING WITH THE FOLLOWING FORMAT BY IDENTIFYING EACH ITEM BY THE APPLICABLE NUMBER AND LETTER: 1. A letter expressing interest in being selected as developer of the Site, and describing any special qualifications and concepts for completing the development. 2. A general description of the proposed development to be undertaken on the Site, including a description of the size and configuration of structures and residential units, proposed parking and landscaping, and prospects for inclusion of compatible community and/or commercial facilities. 3. A statement of the anticipated timetable for development of the Site, including the proposed timetable for acquisition. 4. A statement of the anticipated costs of development and the proposed method and sources of financing. This will provide the Agency with the necessary information to determine the prospective developer's financial capability to complete the development in a timely manner. 5. Identification of the participants on the development team, including the architect and building contractor, along with a brief resume of each team member's experience. 6. A statement indicating the prospective developer's experience in undertaking and completing similar projects of a comparable size and/or scope. -4- 7. A description and supporting documentation of site control held by the proposed developer for any parcels within the Site. IX. PROPOSAL SUBMISSION WRITTEN PROPOSALS ARE REQUIRED IN RESPONSE TO THIS REQUEST FOR PROPOSALS AND MUST BE RECEIVED BY 5:00 P.M., PACIFIC TIME, ON JULY 22, 1994 AT THE REDEVELOPMENT AGENCY OFFICE AT 651 PINE STREET, 4th FLOOR, NORTH WING, MARTINEZ, CALIFORNIA 94553. Each proposal should be accompanied by a reimbursable deposit in the form of a check, payable to the Contra Costa County Redevelopment Agency, in the amount of One Thousand Dollars ($1,000). This deposit will be returned to any unsuccessful developer. The deposit of the selected developer will be retained by the Agency and will be applied to any agreed upon expenses of the developer in the Disposition, Development, and Loan Agreement.
