SPECIFIC REQUEST(S) OR RECOMMENDATION(S) &BACKGROUND AND JUSTIFICATION
I. Recommended Action:
A. APPROVE Right of Way Contract and ACCEPT Grand Deed dated May 10, 1994, from
Larry R..Baines and Rhonda L. Baines.
B. AUTHORIZE Public Works Director to execute said Right of Way Contract on behalf of
the County.
C. APPROVE payment of $3,400.00 for said property rights and AUTHORIZE the Auditor-
Controller to issue a check in said amount payable to Larry R. Bianes and Rhonda L.
Baines, 100 Bedford Lane, Oakley, CA 94561.
D. DIRECT the Real Property Division to have the above referenced Grant Deed recorded
in the office of the County Recorder.
II. Financial Impact:
Payment of $3,400.00 from Oakley, North Brentwood Area of Benefit funds.
III. Reasons for Recommendations and Background:
These property rights are required for the Empire Avenue Widening project in accordance with
the approved plans and specifications.
IV. Consequences of Negative Action:
The project will not have sufficient land rights to allow construction in accordance with the
approved plans and specifications.

Real property in an unincorporated area of Contra Costa County, California, being a portion of
Parcel C as shown on the map of "Subdivision MS 158-72" filed December 8, 1972 in Book 25 of
Parcel Maps at page 29, records of Contra Costa County, California, described as follows:
Beginning at the northeasterly corner of said Parcel C (25 PM 29); thence from the Point of
Beginning, along the easterly boundary of said Parcel C, south 005600" west 330.00 feet to a point
on the southerly boundary of said Parcel C (25 PM 29); thence, along said southerly boundary,
north 89017'30" west 3.00 feet to a point which shall hereinafter be referred to as Point "R"; thence,
leaving said southerly boundary, north 0055'00" east 330.00 feet to a point on the northerly
