Specific Request(s) or Recommendation(s) & Background & Justification
I. RECOMMENDED ACTION:
APPROVE Project, and
DETERMINE that the project is a California Environmental Quality Act Class 1c Categorical
Exemption, and DIRECT the Public Works Director to prepare contract plans and specifications
for construction.
DIRECT the Director of Community Development to file a Notice of Exemption with the County
Clerk.
DIRECT the Public Works Director to arrange for payment of the $25.00 handling fee to the
County Clerk for filing of the Notice of Exemption.
II. FINANCIAL IMPACT:
The estimated project cost is $133,000,funded by Hazard Elimination & Safety (HES) (90%) and
Road Funds (10%).

III. REASONS FOR RECOMMENDATION/BACKGROUND:
The project includes the installation of concrete median barriers and associated safety features
along Kirker Pass Road.
The project has been determined to be in compliance with the General Plan and is exempt from
CEQA because it consists of minor alterations of existing public facilities involving no expansion
of use per Section 15301 of the CEQA Guidelines.
IV. CONSEQUENCES OF NEGATIVE ACTION:
Delay in approving the project will result in a delay of design and construction and may
jeopardize funding.

The project will not have a significant effect on the environment. The recommendation is
based on the following summary of the environmental evaluation:
The project includes the minor modification of existing facilities along Kirker Pass
Road, including the installation of concrete median barriers and associated safety
features. No right-of-way is required as the concrete median barrier will be installed
within the existing eight-foot paved and striped median. The project will not cause
an expansion of use and will not result in the removal of any scenic resources.

GENERAL CONSIDERATIONS:
1. Location: The proposed project is located along Kirker Pass Road, near Pittsburg,
from Nortonville Somersville Road southerly approximately one mile (see Figures 1
and 2).
2. Project Description: The project consists of the installation of Caltrans Type 50
concrete median barriers and associated safety features,from Nortonville Somersville
Road southerly approximately one mile along the centerline of Kirker Pass Road, to
the existing concrete median barrier. No right-of-way is required as the concrete
median barrier will be installed within the existing eight foot paved and striped
median. Left turn access for two parcels will be closed by constructing the median
extension.

SUBJECT: MANDATORY REFERRAL FOR GENERAL PLAN CONFORMANCE
Community Development staff has reviewed the attached project, CP 94-IL to determine
if mandatory referral for General Plan Conformance, as required by Section 65402 of the
Government Code, is necessary.
The project needs no further mandatory referral clearance from County staff subject to the
following actions:
(.� This project has been determined to be exempt from .65402 review.
( ) This project has been determined to be exempt from 65402 review in
accordance with the Board of Supervisors Resolution 81/522 because the
project involves a road alignment project of a minor nature.

The Contra Costa County Community Development Department has completed an initial study of the environmental
significance of the project represented by your pending application bearing County File Number CP 94-16-KIRKER
PASS MEDIAN BARRIER EXTENSION. In conformance with Contra Costa County Guidelines for implementing the
California Environmental Quality Act of 1970 (CEQA), it has been determined that your project will not have a
significant effect on the environment. Your project falls within the following category:
(x) AN ENVIRONMENTAL IMPACT REPORT (EIR) IS NOT REQUIRED.
W) The project is categorically exempt (Class 1c ).
( ) The CEQA requirements are accommodated by the EIR previously prepared for
