HomeMy WebLinkAboutMINUTES - 05311994 - H.A H.A THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on May 31, 1994 by the following vote: AYES: Supervisors Smith, Bishop, DeSaulnier, Torlakson and Powers NOES: None ABSENT: None ABSTAIN: None SUBJECT: Hearing On A Proposal For Mobile Home Rent Control This is; the time set by the Board of Supervisors for consideration of a proposal for mobile home rent control . The following persons presented testimony: Roy Tomlin, 227 Sudan Loop, Pacheco, President of the Contra Costa Mobile Home Owners Association (CoCoMOA) , spoke in support of mobile home rent control . Doug Platt, Bethel Island, member of the Mobile Home Advisory Committee, District V, commented on his corrections to the memo dated May 26, 1994 from Jim Kennedy, Deputy Director, Redevelopment, and he spoke on a moratorium on rents and on the proposed ordinance. Wil Cossel, 16711 Marsh Creek Road #134, Clayton, spoke on the proposed Contra Costa Mobile Home Space Rent Stabilization Ordinance submitted by CoCoMOA on February 8, 1994 . Dan Morrow, 16711 Marsh Creek Road #67, Clayton, Vice- President of: CoCoMOA, spoke on the Consumer Price Index as it relates to the proposed ordinance, and he presented written material . Joe Schneider, 137 Algiers Way, Pacheco, President of the Sun Valley Village Mobile Home Park and Vice-President of the Central District for Contra Costa County Mobile Owners' Association and Board member of Pacheco Municipal Advisory Committee, spoke on the Mobile Home Advisory Committee not doing their job and on the definition of fair return. Wm. L. Rickard, 710 Treasure Drive, Bay Point, resident of Mariner' s Cove, Bay Point, spoke in support of mobile home rent stabilization, and he presented written material . A. Harper, Sun Valley Village Mobile Home Park, Pacheco, spoke on mobile home park rents, the mobile home park owners and presented written comments . Timothy Horan, 122 Renwick Place, Walnut Creek, encouraged the Board to do what is necessary to provide an opportunity for the people in mobile homes to be able to remain in them. Lois Alessandro, 16401 San Pablo Avenue #322 , San Pablo, spoke in support of the adoption of a space rents ordinance, and she read into the record a letter sent to the Board members dated May 14 , 1994 from John E. Jones, resident of Tara Hills Mobile Manor, in support of rent control legislation. John Borrelli, Pacheco Mobile Villa, Pacheco, spoke in support of mobile home rent control . Russ Harris, P.O. Box 458, Bethel Island, Contra Costa County Mobile Home Parkowners' Association, Managing Partner of a Mobile Home Park in East Contra Costa County, spoke in opposition to the proposed mobile home rent control ordinance, and he suggested looking at the establishment of a task force . Gretchen Carter, 2678 N. Main Street, Walnut Creek, spoke in support of mobile home park owners . Paul Deffebach, 307 So. B Street, San Mateo, representing the Western Mobilehome Association, spoke in opposition to the proposed ordinance, and commented on mandatory mediation. Scott Carter, 2678 N. Main Street #22, Walnut Creek, mobile home park owner and manager of mobile home parks, spoke in support of property rights, and in opposition to rent control . Paul Stewart, 3333 Vincent Road #220, Pleasant Hill, Executive Director of the Rental Housing Association in Contra Costa County, expressed concerns with the proposed ordinance . Supervisor DeSaulnier commented on the issues that had been raised today and he suggested that the matter be referred to the Internal Operations Committee to devise the fair composition of a task force, a time frame with which to work, discuss the option of a moratorium, and work with County Counsel and staff in terms of costs, so that the Internal Operations Committee would direct the process and all parties would participate . Supervisor Smith expressed concurrence. IT IS BY THE BOARD ORDERED that the issue of mobile home rent stabilization is REFERRED to the Internal Operations Committee for consideration at its meeting on June 13 , 1994 at 9 : 00 a.m. , as well as the issues of composition of the special task force, a time frame with which to work, consideration of a moratorium, conferring with County Counsel and staff in terms of costs and related issues, and discussion of the Mobile Home Advisory Committee . hereby certify that this is a true and correct copy of an action taken and entered on the minutes of the Board of Supervisors on the date shown. As Constituted, the Committee presently consists of four tenant represontatives (none From District t, one from District 11, two from District IV, and one from District V) t four owners (none from District I. two from District 11, ones from District IV, and one from District V) t and of the throe atOlarga, one is a resident of a mobiles home park in District XV, Dupe to the highly emotional, issue of rent control/stabiliza- tion which has been assigned to the committee, it is most vital that an equal number of tenant and managemont raprea6ntatives be on the oommittee with a group of at-largo member Iarge enough to provide stability and objeativity. TODAY $480. 00 is paid each month for that same identical space - PLUS ALL UTILITIES . SERVICES AND FEES. (including water and garbage) . There are 263 spaces in the Park (SUN VALLEY .VILLAGE) and the spaces rent from $480. 00 to well over $500. 00 a month; therefore the lowest } possible yearly gross income for this Park Owner is : ONE MILLION FIVE HUNDRED FOURTEEN THOUSAND EIGHT HUNDRED AND EIGHTY DOLLARS plus extra money for,,the two Laundry Mats. and at Beauty Shop 'in, the park [ $480. 00 X 12 months= $5 ,760. 00 X 263 spaces = $ 1 ,514 ,880. 00 ] MOBILE HOME OWNERS ARE CAPTIVE RENTERS . There are no available spaces to move to and all spaces are overpriced. Even if a space is available THE COST TO MOVE A MOBILE HOME ONCE IT HAS BEEN SET UP IS EXORBITANT. It must be dismanteled, moved by a professional mover and set up again. Apartment owners are responsible for the upkeep of the apartment bldg. We are not only responsible for the upkeep of our Mobile Home but also the space our home sets on, including Landscaping (Park Owner rule) . We are not permitted to rent out our Mobile Home (another Park Owner rule) . We can sell only at Park Owner"s discretion--the Park Owner if sold can refuse to let the Mobile stay in the park for any made up reason. No one will buy a mobile home if they don't have a space to put it on. OUR HOME IS NOT OUR CASTLE. The Park Owner is Lord and Master, he makes all the rules . WE ARE FEUDAL TENANTS . THIS IS NOT FREE ENTERPRISE THIS IS MODERN FEUDALIZATIONS . MQBILE"PARKSSHOULD BE CLASSIFIED AS A PUBLIC UTILITY. U 'bb A. May 15, 1994 CLERK BOARD OF SUPER%nSORS CONTRA COSTA CO. Dear Supervisor Powers; We were in attendance at the May 11th Supervisors meeting, and were prepared to speak on our own behalf as owners of a small Mobile Home Park. As it turned out, Mr. Paul Deffebach spoke for us and all the park owners. We must protest a statement by the opposition. The vice president of CoCoMOA claimed to represent all the mobile home owners in all the parks of Contra 'Costa County. This is a great exaggeration since we understand only three or four parks are the cause of this push for rent control. Our residents know nothing of this vice president, and we spoke with other owners in our area and this person does not represent their residents either. He should stop exaggerating his representation.. The first our park heard of these rude organizers was when they passed out a flyer about rent control in our park a month ago. I. BACKGROUND A. There are 25 mobilehome parks in Contra Costa County with 20 or more spaces, including- 19 ncluding:19 parks in District 5 1 park in District 2 3 parks in District 4 2 parks in District 1 0 parks in District 3 B. On March 1, 1994, the Board of Supervisors received a petition from residents of Clayton Regency Mobilehome Park (District 5) requesting the adoption of a rent stabilization ordinance for Contra Costa County (Agenda Item 1.85) . The petition was referred to the Contra Costa County Mobilehome Advisory Committee (MHAC) , the Community Development Department, and County Counsel. C. On May 10, 1994, the Board heard additional public comment from selected representatives of mobilehome park owners and residents (Agenda Item 1.61) . The Board deferred consideration of rent stabilization issues to a special meeting on May 31, 1994. D. Public testimony and correspondence received by the Board and the MHAC since February 1994 both disputes and supports the need for rent stabilization in the County's mobilehome parks. 1. Issues identified by park residents include: o "Excessive" rent increases; o Rent pass-throughs; o Inability to sell mobilehomes due to high rent costs; o Park owner restrictions on resident subleasing; o Lack of adequate park maintenance; o Uneven enforcement of park rules; o Alleged health and safety code violations; and 0 Lack of communication with owners concerning rent increases, etc. 2. Concerns raised by park owners/managers include: o Increases in costs (e.g. , maintenance, fees, taxes, long-term capital improvements) which require rent increases in order to maintain financial viability; and o The inability of park owners to earn a "fair return" and continue operations under rent stabilization/control. II. MOBILEHOME ADVISORY COMMITTEE ACTION ON RENT STABILIZATION REFERRAL A. At their May 19, 1994, meeting, the MHAC considered a motion to recommend that the Board of Supervisors approve the Mobilehome Rent Stabilization Ordinance submitted to the Board by residents of Clayton Regency Mobilehome Park for enactment in Contra Costa County. The proposed motion was defeated on a six to two vote. B. Based on MHAC comments during the discussion, this action should be viewed as a vote on the specific ordinance recommended rather than on the overall issue of rent stabilization. Some members stated that they did not feel qualified to determine the legality or adequacy of a specific ordinance. In addition, two Committee members who voted no expressed the view that rents in some parks are "probably" too high. One additional member stated his concern that the nature and magnitude of the rent problem should be clearly established before proceeding to potential solutions. III. RENT STABILIZATION ISSUES - OUTLINE A. What is the problem? o Rents - what's fair? o Uncertainty over future rent increases? o Park maintenance and amenities? o Resale/subleasing restrictions? o Enforcement of park rules? o Communication? o Countywide or isolated? o Inadequate incomes? o Coach conditions? B. Solutions depend on nature of problem. 1. Affordability: o Rent subsidies; o Tenant/non-profit acquisition of parks. 2. "Excessive" rent increases in selected parks: o Mediation/conflict resolution (targeted) ; 0 Binding arbitration. 3. "Excessive" rent increases pervasive/countywide: o Mediation/conflict resolution (large-scale) ; o Binding arbitration; o Rent stabilization/control. C. Rent stabilization issues. 1. Ordinance terms: o Formula for allowable rent increases; o Coverage (park size, age, etc.) ; o Appeals process for owners and residents; o Penalties for noncompliance; o Monitoring and enforcement. 2. Administration: o Assignment of responsibility for administration, monitoring, enforcement, and litigation. o Required budget support (information from a small sample of jurisdictions indicates a range in administrative and litigation costs from $40,000 to over $120,000 annually) . o Source of funds (General Fund, fees to park owners/pass through to residents) IV. ALTERNATIVE PROCEDURAL APPROACHES Alternatives for assessing rent stabilization issues and developing recommendations for consideration by the Board of Supervisors include the following: A. Refer issue to Board of Supervisors Internal Operations Committee for assessment and recommended action (suggested by correspondence accepted by Board at May 24, 1994, Board meeting, Agenda Item 1.75) . B. Establish a special Task Force (discussed at May 10, 1994, Board meeting) . 1. Composition - Task Force should consist of no more than five to seven members representing a combination of some or all of the following: o Park owners (corporate, small park); o Residents; o MHAC representative; o At-large/independent citizen representatives with no vested interest; o Board representative; o Conflict resolution or arbitration specialist. If a Task Force composed of owners and residents is selected, the Task Force will be more likely to be effective if the representatives are nominated by and authorized to negotiate on behalf of their constituent group. 2. Task Force Mission/Responsibility: o Define the nature and magnitude of rent ,control problems in County mobilehome parks. o Develop recommendations to the Board of Supervisors concerning solutions to identified problems. o Identify potential funding sources to support administration and enforcement of proposed solution. o . Charge may be broadly or narrowly defined (e.g. , focus on rent issue only or broader range_.of problems which may exist in mobilehome parks, including park maintenance, subleasing restrictions, enforcement of rules, etc.) . 3. Timing- 0 iming:o Task Force to complete fact-finding and report to Board of Supervisors within three months, six months, etc. o Time required to complete task will depend on how narrowly the Board defines the Task Force mission and whether or not the Board provides resources for technical support (e.g. , information gathering, identification and assessment of alternatives, conflict resolution and negotiation) . C. Clarify referral to Mobilehome Advisory Committee to request assessment of identified issues and the development of specific recommendations to the Board concerning potential solutions. Issues concerning mission and timing same as for Task Force alternative. V. ADMINISTRATIVE ISSUES 1. Depending on the mission defined by the Board,' the Task Force and MHAC alternatives discussed under IV.B and C will most likely require substantial technical support. The Community Development Department is not able to undertake an independent assessment of this issue or provide the required staff support to the MHAC or a special Task Force. 2. Administrative alternatives - Board of Supervisors could: o Provide additional resources for consultant to analyze issues and/or work with MHAC or Task Force (preliminary estimates suggest a cost of $30,000 to $50,000 depending on the breadth of the charge provided by the Board of Supervisors and the resultant scope of work) . o Assign responsibility to another entity within the County.
