This is to request-Board action to bring closure on two labor relations matters
affecting both rank and file and management employees in the District Attorney
Investigative Section. The items are:
1 . Adoption of the attached side letterwith the District Attorney Investigator's
Association (DAIA) which will (a) officially terminate the Ist Choice Health
Plan and (b) set up a Flexible Benefit Account for the 19 member DAIA to
distribute estimated premium savings in 1994 and 1995 as was done with
the Deputy Sheriffs Association.
The side letter is identical in every way with the rank and file DSA side letter
except that the projected 1994 savings for DAIA will be $845 per member
vs $720 per member in DSA.
The proposed settlement has the approval of the DAIA members.
2. Adoption of the attached Resolution extending the same salary increase as
was bargained by DSA for newly-represented Captains and Lieutenants to
the three Unrepresented Management classes of District Attorney-Chief of
Inspectors (Exempt), District Attorney Lieutenant of Inspectors and District
Attorney Supervising Welfare Fraud Inspector. Only the Chief and Welfare
Supervisor positions are currently filled.
The recommendation is not to extend the Flexible Benefit Account to these
managers since they remain Unrepresented. They should however receive
the scheduled increases of 4.5% on 7/1/94, 4.0% on 10/1/94 and 4.0% on
1/1/95 as is scheduled for Lieutenant and Captain since parity between
these sworn law enforcement occupations has been established since 1987.
Cost estimates for this salary adjustment in fiscal year 1995-1995 are
approximately $12,000. This adjustment has the recommendation of the
District Attorney.

SIDE LETTER BETWEEN
CONTRA COSTA COUNTY & D.A. INVESTIGATORS' ASSN.
RE MODIFICATIONS TO 1991 -1995 MEMORANDUM OF UNDERSTANDING
This letter affirms agreements reached between the County and the District
Attorney Investigators'Association regarding termination of the 1 st Choice Health
Plan, initiation of a Flexible Benefit Account for 1994 and 1995 and related
adjustments to medical coverage.
The parties having met and conferred in good faith agree as follows:
1 . Health Coverages: Effective February 1 1994 the County will offer medical
plans including Contra Costa Health Plan (CCHP), Kaiser, QualMed, Delta
Dental, and Safeguard Dental.
2. Health Plan Subvention: Effective February1 , 1994 CCHP=98%County share;
QualMed/Kaiser HMO's=79% County share. QualMed PPO=77% County share
to October 31 , 1994.
3. Dental Benefit Increase: Effective February 1 , 1994 Delta Dental annual
maximum benefit per member is increased from $1 ,000 to $1 ,200.
4. Kaiser Copays: Effective February 1 , 1994 Kaiser office visit= $3.00; Kaiser
drugs = $3.00.
S. Future QualMed PPO Increases: Effective November 1 , 1994 the County and
the employees will equally share (50/50) the amount of any premium
increases to the PPO option which have been guaranteed by QualMed to be
a maximum of nine percent (9%).
6. Runout: The County agrees to assume all runout costs associated with
termination of the 1 st Choice Health Plan and indemnify the 1 st Choice
trustees.
7. Open Enrollment: Open enrollment shall be in November of each year.
Between February 1 , 1994 and july 31 , 1994 QualMed members may change
either from the PPO to the HMO and/or from the HMO to the PPO once each.
8. Flexible Benefit Account for 1994: Effective as soon as possible but no later
than" nine (90) days of signing this agreement, the County will establish a
Flexible Benefit Account for each DAIA member in accordance with the
provisions of the IRS Code Section 125. The County will contribute eight
hundred forty-five dollars ($845) into each employee's Flexible Benefit
Account for 1994.

9. Flexible Benefit Account for 1995: The amount to be contributed for 1995
shall be the actual savings for 1994 as determined by comparing 10/93 1 st
Choice enrollment data to 10/94 QualMed enrollment data minus the
projected savings of sixteen thousand and sixty-eight dollars($16,068)plus
nine months' worth of savings projected for 1995 based on 10/94
enrollment data.
10. Individual Enrollment Problems: The County will joint with DATA in
negotiating resolution of any individual enrollment or coverage problems
which may occur with the transfer of 1 st Choice members to QualMed.
11 . Wellness Incentive: The parties have agreed that the County subvention of
premium for employees who are enrolled in either the Kaiser or QualMed
medical plan option shall be increased by 1% upon written verification from
the employee that he/she maintains a healthy lifestyle which excludes
alcohol abuse and use of tobacco products. -
The parties agree to recommend adoption of this side letter to the Contra Costa
Board of Supervisors:
