SUBJECT: EMPIRE AVENUE WIDENING PROJECT - OAKLEY AREA

SPECIFIC REQUEST(S) OR RECOMMENDATIONS) & BACKGROUND AND JUSTIFICATION
I. Recommended Action:
A. APPROVE Right of Way Contract and ACCEPT Grant Deed dated May 4, 1994 from
Lewis E. Bradley and Laura Bradley.
B. AUTHORIZE Public Works Director to execute said Right of Way Contract on behalf of
the County.
C. APPROVE payment of $1,210.00 for said property rights and AUTHORIZE the Auditor-
Controller to issue a check in said amount payable to Lewis E. Bradley and Laura
Bradley, 1988 W. Cypress Road, Oakley Ca., 94561.
D. DIRECT the Real Property Division to have the above referenced Grant Deed recorded
in the office of the County Recorder.
II. Financial Impact:
Payment of $1,210.00 from Oakley/North Brentwood Area of Benefit funds..
III. Reasons for Recommendations and Background:
These property rights are required for the Empire Avenue Widening project in accordance with
the approved plans and specifications.
IV. Consequences of Negative Action:
The project will not have sufficient land rights to allow construction in accordance with the
approved plans and specifications.

Real property in an unincorporated area of Contra Costa County, California, being a portion of Lot
95 as shown on the map of "Subdivision No. 5317 The Vineyard No. 3" filed May 15, 1979 in Book
224 of Maps at page 42, records of Contra Costa County, California, described as follows:
Commencing at the southeasterly corner of said Lot 95 (224 M 42); thence along the southerly
boundary of said Lot 95, north 89014'5811 west 56.05 feet to the Point of Beginning, said point shall
hereinafter be referred to as Point "A"; thence from the Point of Beginning, along the boundary of
Lot 95, westerly, northwesterly and northerly along the arc of a curve, concave to the northeast,
having a radius of 20.00 feet, through a central angle of 90010'27", a distance of 31.48 feet to a point
which shall hereinafter be referred to as Point "B"; thence, non-tangent to said curve leaving the
boundary of said Lot 95, .south 44°09'4511 east 28.33 feet to the Point of Beginning.
Containing an area of 85 square feet of land, more or less.
RELINQUISHMENT OF ABUTTER'S RIGHTS:
