SPECIFIC REQUEST(S) OR RECOMMENDATION(S) &BACKGROUND AND JUSTIFICATION
I. Recommended Action:
A. APPROVE Right of Way Contract and ACCEPT Grant Deed and Grant of Easement, both
dated April 29, 1994, from Black Iris Land Corporation.
B. AUTHORIZE the Public Works Director to execute Right of Way Contract on behalf of the
County.
C. APPROVE payment for said property rights and AUTHORIZE the Auditor-Controller to
issue a check for $30,600 payable to Chicago Title Insurance Company, 590 Ygnacio
Valley Road, Suite 300, Walnut Creek, CA., 94596, Escrow No. 75722, to be forwarded
to the Real Property Division for delivery.
D. DIRECT the Real Property division to have the above-referenced Grant Deed and Grant
of Easement recorded in the Office of the County Recorder.
II. Financial Impact:
Payment totalling $30,600 from South County Area of Benefit Funds.

III. Reasons for Recommendations and Background:
This project was generated in response to a high incidence of traffic accidents at the intersection
of Camino Tassajara and Highland Road. The problem is caused by inadequate sight distances
along the curves approaching Highland from both directions. The realignment project will
improve sight distances and also provide a left-turn pocket. These property rights are required
to meet project specifications.
IV. Consequences of Negative Action:
The project will not have sufficient land rights to allow construction in accordance with the
approved plans and specifications.

THIS INDENTURE, made by and between BLACK IRIS LAND CORPORATION, a California
corporation, hereinafter called "Grantor", and CONTRA COSTA COUNTY, a political
subdivision of the State of California, hereinafter called the "Grantee",
WITNESSETH:
That the Grantor, for value received, hereby grants to the Grantee and to its successors
and assigns the right from time to time to construct, reconstruct, install, inspect, maintain,
replace, remove, and use facilities of the type hereinafter specified, and also ingress
thereto and egress therefrom over and across the lands situate in the County of Contra
Costa, State of California, described as follows:

Said facilities shall consist of all necessary poles, aerial wires, electrical conductors with

being a portion of Lots 1 and 2 "Map of Property of the Estate of Elizabeth A. Dougherty" filed May
4, 1891 in Book C of Maps at page 63, also being a portion of that parcel of land described in the
deed to Black Iris Land Corporation, a California Corporation, recorded January 11, 1993 in Book
