FROM: Mark Finucane, Health Services Director Contra «y Costa DATE: May 24, 1994 County .r SUBJECT: SUPPORT AB 3480(BATES)-AMENDMENTS TO THE HEALTH AND SAFETY CODE REQUIRING DOUBLE CONTAINMENT OF STRUCTURES CONTAINING ACUTELY HAZARDOUS MATERIALS IF SPECIFIC FINDING ARE MADE REGARDING PUBLIC SAFETY SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMMENDATION: SUPPORT AB 3480 which amends the section of the Health and Safety Code regarding Risk Management Prevention Program (RMPP) review by Health Service Department staff. This bill will require the RMPP specialists in the Health Services Department to require the owner or operator of a facility to handle ARMs using methods, techniques, structures or equipment that are capable of containing an accidental release of AHMs in order to prevent their escape into the environment. FISCAL IMPACT: None. BACKGROUND: The proposed legislation will require the RMPP specialists to add a new level of protective measures to their review of RMPPs. The new protective measures will require the double containment of any structure containing AHMs if: there is a significant likelihood of AHMs escaping the facility; the protective measures currently in place are likely to fail; and there could be an imminent danger to public health and safety or cause the closure of major transportation routes if ARMs are released from the facility One of the major purposes of RMPPs is to evaluate and attempt to prevent off-site consequences of accidental releases of ARMs. RMPP specialists in the Health Services Department are trained as chemical engineers and have professional experience working at industrial facilities that utilize AHMs. These specialists are thereby uniquely qualified to evaluate an RMPP submitted by a facility to ascertain whether proposed engineering techniques currently utilized or proposed by a facility will reduce off-site consequences in the event of an accidental release of ARMs. CONTINUED ON ATTACHMENT: SIGNATURE RECOMMENDATION OF COUNTY ADMINISTRATOR RECOMMENDATION OF BOARD COMMITTEE APPROVE OTHER SIGNATURE(S): ACTION OF BOARD ON ")'� _ �� q 9 q APPROVED AS RECOMMENDED �/ OTHER VOTE OF SUPERVISORS / I HEREBY CERTIFY THAT THIS IS A TRUE y UNANIMOUS (ABSENT ) AND CORRECT COPY OF AN ACTION TAKEN AYES: NOES: AND ENTERED ON THE MINUTES OF THE BOARD ABSENT: ABSTAIN: OF SUPERVISORS ON THE DATE SHOWN.
