Recommended Action: A. APPROVE the following Project Priority List for Contra Costa County's Transportation Development Act Article 3 funds for Bicycle/Pedestrian Path projects for Fiscal Year 1994-95, and direct the Clerk of the Board to forward the list to the Metropolitan Transportation Commission (MTC) for final approval and allocation of funding effective July 1, 1994. B. APPROVE requested reallocation of Concord's 1991-92 grant of $110,000 for the Walnut Creek Trail project. C. APPROVE withdrawal of Contra Costa County from the 1993-94 Rodeo Waterfront Bike Lanes project and APPROVE the use of the excess 1993-94 grant funds from the Rodeo Bike Lanes project, in the amount of $42,994, for the 1994-95 Transportation Development Act Article 3 projects. Reasons for Recommendations and Background: In 1978, a procedure was recommended by the Conference of Mayors and adopted by the County Board of Supervisors to insure county-wide consensus in funding bicycle and pedestrian projects with TDA money. In 1991, the Metropolitan Transportation Commission (MTC) required TDA applicants to have the TDA projects reviewed by a city or countywide bicycle advisory committee. In accordance with those procedures, each City and the County submitted applica- tions for 1994-95 TDA funds for bicycle and pedestrian facilities. The Countywide Bicycle Advisory Committee reviewed the projects in November of 1993. The TDA Subcommittee, a subcommittee of the City/County Engineering Advisory Committee (CCEAC), met in late December to review the TDA applications submitted for funding consideration. Twelve projects, totaling almost $1,500,000, were reviewed by the subcommittee. This year's subcommittee is made up of representatives from EI Cerrito, Martinez, Pittsburg, Lafayette, the Metropolitan Transportation Commission, the County, the East Bay Bicycle Coalition, the Regional Bicycle Advisory Committee and the East Bay Regional Park District. The attached exhibit lists all of the submitted projects. MTC estimated (preliminary) that $465,170 would be available for 1994-95 TDA Article 3 funds in Contra Costa County. Based on the criteria established to prioritize proposed projects, the subcommittee recommended that the CCEAC accept a proposed project list for the 1994-95 TDA Article 3 funds. The TDA Subcommittee reviewed the City of Concord's request for reallocation of funds. The project has been held up pending completion of planning studies to determine the proper alignment of the trail. The Subcommittee recommended approval of the City's request. The TDA Subcommittee also recommended a $15,000 maximum partial funding for the Orinda project. The CCEAC approved the recommended priority list on January 7, 1994, with one modification. It raised the funding limit on the Orinda project from $15,000 to $30,000. This would allow Orinda to receive more funds if TDA revenues exceeded MTC's fund estimate. This modification, plus an additional recommended over programming of$1080, increased the TDA project list to a maximum of $481,250. In February, after the CCEAC had approved the priority list, MTC finalized their fund estimate and discovered it was $45,807 less than the preliminary estimate of $465,170. This eliminated funds to the Orinda project and eliminated most of the funds to the Pinole project. At the same time, however, the County was withdrawing from the 1993-94 Rodeo Waterfront Bike Lanes grant, which released $42,994 in funds from the previous year. The County had only received 46% of the funding request for the Rodeo project in 1993-94, since it was the last project on the priority list. County staff has spent the last year trying to make the project work with the reduced funding, but cannot come up with a feasible project. Staff will continue to seek funding for this project or other projects that the Rodeo community and specific planning effort identifies as a priority project for Rodeo. The excess funds from the Rodeo project just about make up the difference in the MTC fund estimates. On March 4, 1993, the Contra Costa Conference of Mayors approved the proposed priority list. The priority list has been reviewed by the Transportation Committee. The CCEAC requests approval of the project list for the 1994/95 TDA Article 3 funds. Subsequent to adoption of the list by the Board of Supervisors, the priority list must be forwarded to the Metropolitan Transportation Commission for final approval and funding allocation. IV. Consequences of Negative Action: Failure to approve the project list will result in a delay in the MTC process of allocating TDA funds in the Contra Costa County area and delay reallocation of funds to the City of Concord. Mt Diablo Boulevard Bike Lanes The project must be reviewed by the Countywide Bicycle Advisory Committee. 2. Reliez Valley Bike Trail Phase II The City shall enter into an agreement with the East Bay Regional Park District to collect developer fees from the properties fronting the trail project and to forward the fees to the District to fund the northerly extension of the trail through the District property. 3. Bicycle Safety Education The Health Services Department shall look for funding from other sources. Funding may not be approved for next year. If funding is approved next year it will not be at the same level as the last two years. 4. Orinda Way Access Ramp The City shall use the TDA funds to only construct the ramp from Orinda Way to the park. 5. Walnut Creek Channel Trail The city shall examine an alignment along the creek, crossing Monument Boulevard under the creek bridge. The City shall report back to the TDA Subcommittee in writing with the results of the alignment study.
