FISCAL IMPACT None. REASON FOR RECOMMENDATION/BACKGROUND The Keller Canyon Landfill Local Advisory Committee was formed in compliance with the Land Use Permit 2020-89 Condition of Approval 11.2. The objective of this Committee is to comment and advise on the development and operations of the Keller Canyon Landfill. Condition 11 .2 states that "subjects for consideration [by the Committee] at meetings include, but are not limited to safety and emergency procedures, landfill fill-related traffic problems, screening of visual impacts and problems of litter, odor and noise control". The Committee adopted their own By-Laws which state that "the Committee shall submit an annual (calendar year) report to the Board of Supervisors of the Committee's activities, accomplishments, attendance, and a proposed program for the forthcoming year". This Annual Report is being submitted for the 1993 calendar year to comply with the requirements stated in the Committee's By-Laws. COMMITTEE MEETING SCHEDULE 5 ACTION PROGRAM FOR 1994 6 APPENDIX A - COMMITTEE MEMBERSHIP TABLE 7 APPENDIX B - COMMITTEE ATTENDANCE TABLE 8 ii PURPOSE OF THIS ANNUAL REPORT This report is being submitted pursuant to the By-Laws of the Keller Canyon Landfill Local Advisory Committee, which states that "the Committee shall submit an annual (calendar year) report to the Board of Supervisors of the Committee's activities, accomplishments, attendance, and a proposed program' for the forthcoming year" (By-Laws, Section III.A.M.). The purpose of this Annual Report is to inform the Board of Supervisors about the Committee's endeavors. OBJECTIVE OF THIS LOCAL ADVISORY COMMITTEE This Committee was called for by the Keller Canyon Landfill Land Use Permit 2020-89 Condition of Approval 11.2. The objective of this Committee is to advise and recommend to the County Board of Supervisors on the development and operations of the Keller Canyon Landfill. FUNCTIONS OF THIS LOCAL ADVISORY COMMITTEE The functions of this Committee (according to the Keller Canyon Landfill Land Use Permit and the Committee's By-Laws) are: 1. consideration of landfill related matters (including traffic, litter, odor and noise control, screening of visual impacts, and safety and emergency procedures); 2. providing a forum for landfill-related issues; 3. coordination between the public and the County in resolving complaints; and 4. discussion of reports on landfill construction, operation and maintenance. ISSUES FACED BY THIS COMMITTEE IN 1993 1. LIFE OF THE'COMMITTEE Background: Keller Canyon Landfill Land Use Permit Condition of Approval (COA) 11.2 only requires the Committee to meet on a regular basis for two years following the start of landfill operations. The landfill began operations in May 1992. Therefore COA 11.2 only requires that the Committee continue to meet through May 1994. The Property Valuation Study is not expected to be completed until late Summer or early Fall of 1994. The Committee felt it was important that they continue to meet until the Property Valuation Study is complete and the results are presented. Keller Canyon Landfill Local Advisory Committee 1 Annual Report - 1993 Committee Actions/Accomplishments: In November 1993 the Committee voted to send a letter to the Board of Supervisors recommending that the life of the Committee be extended through the 1994 calendar year. 2. PROPERTY VALUATION STUDY Background: During 1993 the Committee was given updates on the progress of the Property Valuation Study which is being done by the Institute for Community Planning Assistance from Sonoma State University. No study results were available or presented, however the Committee was informed of the current study activities as well as details of how the study was being administered. The Property Valuation Study is expected to be completed by the late Summer or early Fall of 1994. Committee Actions/Accomplishments: The Committee discussed matters related to the Property Valuation Study after presentations were made by the Institute for Community Planning Assistance. Related to the issue of the Property Valuation Study was the Committee's recommendation to the Board of Supervisors that the committee continue to meet through 1994 (as discussed above in Issue 1 "Life of the Committee"). 3. DIRECT HAUL/SPECIAL WASTES Background: Early in 1993 the Committee was informed of a request by the Gaylord Container Corporation for authorization to initiate a one week trail period during which Gaylord could haul waste directly to Keller Canyon Landfill. Gaylord cited cost, traffic, and the fact that their waste could not be practicably handled at a transfer station as reasons for their direct haul request. Gaylord has not pursued a long-term agreement to direct haul their waste to Keller Canyon Landfill. Late in 1993 Keller Canyon Landfill requested authorization to import special wastes from outside Contra Costa County. The Board of Supervisors authorized said import at their meeting of.December 14, 1994. Committee Actions/Accomplishments: In February 1993 the Committee voted to endorse the one week pilot program to determine the feasibility of direct haul from Gaylord to Keller Canyon Landfill. In February 1993 the Committee also voted that they would most likely concur with an agreement if Contra Costa County were to make such an agreement with the Gaylord Container Corporation for direct haul after the one week trial (if said agreement was brought back to the Committee). Keller Canyon Landfill Local Advisory Committee 2 Annual Report - 1993 In October 1993 the Committee voted to send a letter to the Board of Supervisors opposing the blanket pre-approval for Keller to receive out-of-County special wastes. 4. ROAD IMPROVEMENTS Background: In' 1993 the Committee was kept informed of the progress of Bailey Road improvements and the Highway 4 Interchange Project which is occurring in the vicinity of Bailey Road and Highway 4. The Bailey Road improvement project encompassed 900 feet of roadway which is within the City of Pittsburg. Construction for the improvements began in June 1993 and were completed around August 1993. This work was done by contractors hired by Keller Canyon Landfill. The public works departments of both the City of Pittsburg and Contra Costa County were responsible for inspecting the improvements. The Highway 4 Interchange Project is an ongoing project being handled by Caltrans. In October 1993 a presentation was made by representatives from Caltrans. The presenters explained how the Interchange Project was expected to progress, including the traffic management techniques employed to help minimize congestion in the project vicinity. Committee Actions/Accomplishments: No action was necessary on this issue. The Committee requested that they be kept updated on the progress of these projects. The Committee expressed concerns that these road improvement and construction projects would compound existing traffic problems in the vicinity of Bailey Road and Highway 4. 5. MITIGATION FEES Background: During 1993 the Committee discussed and took action on the issue of Host Community Mitigation Fees and the allocation of those funds. Aside from receiving updates from County staff, a presentation was made to the Committee in October 1993 by Val Alexeeff, Director of the Contra Costa County Growth Management and Economic Development Agency. Committee Actions/Accomplishments: In May 1993 the Committee voted to send a letter to the Board of Supervisors recommending that the Committee be the sole responsible party to make recommendations to the Board on distribution of the "$2/$2/$2" mitigation funds. In June 1993 the Committee agreed to refrain from action on the May motion and therefore did not send the letter. In July 1993 the Committee brought the issue back and after discussion voted to send a letter to the Board of Keller Canyon Landfill Local Advisory Committee 3 Annual Report - 1993 I Supervisors informing them of the Committee's concern over the possible discontinuation of the mitigation fees, in particular the Host Community Mitigation Fee, and concern that the Committee itself be consulted and involved in the dispersement of the fees. Related to the Mitigation Fee issues was the vote by the Committee in July 1993 to continue to hold "special" meetings until the allocation issue for these funds had been settled (as discussed below in Issue 8 "Committee Meeting Schedule"). 6. LANDSCAPING/WATER SERVICE Background: Throughout 1993 there had been an ongoing situation regarding Keller Canyon Landfill's request for water from the City of Pittsburg for landscaping plantings along Santa Maria Drive and Jacqueline Drive (in the City Limits). Keller Canyon Landfill had requested the use of City water for several years, which is just long enough to assure that new plantings can become established. The Keller Canyon Landfill representatives were awaiting a decision from the City of Pittsburg before implementing the landscaping plantings. The City of Pittsburg had not said definitely that the water would or would 'not be provided, however there were instances where it seemed very likely that the water would not be made available to the landfill operators. The landfill operators did plant some landscaping along Santa Maria Drive using an alternative plan for watering because the City water remained unavailable. Throughout the year the Committee received updates on the status of the landscaping/water service issues. Committee Actions/Accomplishments: The Committee had multiple discussions throughout the year trying to reach a resolution to the problem of water for the landscaping. In July 1993 the Committee voted to advise the City of Pittsburg that the Committee endorsed the City's providing water meters to Keller Canyon Landfill for landscaping needs. At the November 1993 meeting the Committee voted that if within a months time there had not been some resolution to the problem that the Committee would write a letter to the Board requesting that the landfill operator be required to begin the landscaping plantings along Jacqueline Drive. However within that months time the landfill operator.began work on establishing an alternative plan for landscaping on Keller Canyon Landfill property to screen views from Jacqueline Drive, that would not require water from the City of Pittsburg. 7. COMMITTEE MEMBERSHIP/QUORUM Background: In 1993 the membership of the Committee diminished. The membership changes were a result of an effort by the Committee to try and obtain quorums for the meetings, through elimination of those seats held by organizations that were attending Keller Canyon Landfill Local Advisory Committee 4 Annual Report - 1993 infrequently and were no longer interested in participating. There were quorums at only five of the nine Committee meetings during 1993. For detailed information on current Committee Membership please see Appendix A. For detailed information on. Committee Attendance please see Appendix B. Committee Actions/Accomplishments: Beginning with the first meeting of 1993 the Committee periodically discussed and considered the difficulties of obtaining quorums for their meetings. As of the first of the year there were 15 members, in February the Board of Supervisors approved the removal of the BART seat from the Committee. In April the Committee discussed a need to contact members/organizations that had not attended three consecutive meetings and gave no prior notification of their absence; the letter would ask whether they would like to continue to serve or ask for resignations. At the Committee's request County staff surveyed the members by phone asking whether each member wished to continue to serve. As a result two of the members requested to be removed from the Committee (one organization, Delta Board of Realtors, had an appointed alternate member who later became the member; but the other organization, Transplan, did not appoint an alternate or replacement). In May letters were mailed to Transplan and the City of Concord which indicated that if no reply was received regarding membership that the Committee would recommend to the Board of Supervisors that the seats be removed. The Board of Supervisors removed the seat for Concord and the vacant seat for the Industrial Representative in July and removed the; seat for Transplan in October. Together these activities resulted in downsizing the Committee to 11 members, which reflects the membership to date. The Committee is hopeful that with the new membership quorums can be obtained regularly. 8. COMMITTEE MEETING SCHEDULE Background: In the middle of 1993 the Committee decided to reduce the amount of meetings held per year (from monthly to every other month) in an attempt to obtain quorums and hold more productive meetings. Committee Actions/Accomplishments: At the Committee's request County staff surveyed members over the phone and asked whether changing meetings from monthly to every other 'month or quarterly would be preferable. Eight members indicated quarterly meetings would be preferable, and only four members indicated that meeting Keller Canyon Landfill Local Advisory Committee 5 Annual Report - 1993 every other month was preferable. In July the Committee voted to hold meetings every other month, with the exception of holding "special" meetings on the off-months until the Mitigation Fee issue had been resolved (Committee stopped holding "special" meetings at their October meeting because there was no further Committee action which could be taken to influence or guide this years mitigation fee appropriations). ACTION PROGRAM FOR 1994 1. Nominate and elect Chair and Vice-Chair of the Committee. FIRST QUARTER 2. Receive update on transportation improvements occurring in the vicinity of the landfill; including the Highway 4 widening, Highway 4/Bailey Road interchange and BART projects. SECOND/THIRD QUARTER 3. Receive update and the results of the Property Valuation Study. THIRD QUARTER 4. Continue to receive updates on the landfill operations.
