SUBJECT: ASSEMBLY BILL 2563
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) &BACKGROUND AND JUSTIFICATION
I. Recommended Action: -
OPPOSE Assembly Bill 2563 and DIRECT the Public Works Director to,take the necessary steps
to oppose the Assembly Bill 2563.
II. Financial Impact:

III. Reasons for Recommendations and Background:
Assembly Bill 2563, as proposed, will allow any local agency to close any public road,to the
public, but will allow a selected group of citizens the use of the road. It will modify a section of
the Vehicle Code that was introduced by Contra Costa County about twenty years ago
prohibiting local agencies from closing a public road to some people while allowing others use
of the road. It was a result of a lawsuit the County filed against the City of Lafayette over the
closure of Upper Happy Valley Road by the City with a card operated gate. Citizens that live
along Upper Happy Valley Road were issued magnetic cards so that they had access to the
road.
The basis for the suit was that every citizen has the right to use any public road since public
funds are used to construct and maintain such facilities. We believe the mobility of our citizens
will be adversely impacted if local agencies start to close off roads to keep non-city residents
from using the road.
