Dear Mr. Powers: A recent Antioch Ledger article indicated that you plan to introduce an ordinance that may ban gun dealers from running businesses out of their homes in unincorporated areas. As a legitimate gun dealer, I strongly object to any such ordinance. Three years ago I established a small firearms and reloading business and have gradually been building this business up in anticipation of retirement, in a few years, from.my present position as an Assistant Deputy Associate Director at Lawrence Livermore National Laboratory. I have a fictitious business license, a county business license, state tax permit, permit to store and sell smokeless powder, a FFL (I was inspected by the BATF in 12/93 as part of the renewal process), a certificate of elgibility from the Dept. of Justice (DOJ) to sell firearms, and am now a licensed course provider and course instructor by DOJ to teach the newly implemented firearms safety course required to purchase a handgun. I have spent considerable time and resources on my business and am proud of the service I am able to provide my customers; this includes minor gunsmithing. California has among the toughest gun laws in the United States; keeping up with changes to these laws and new laws takes significant administrative effort. Contra Costa County does not need to go after the legitimate gun dealers such as myself but instead should crack down on the illegitimate people who are not complying with the myriad of state and county rules to operate a business. I am enclosing copies of two other letters sent to you last year. Unfortunately even though I sent you a great deal of information on gun safety I never had the courtesy of a reply from you. This makes me wonder if you have an open mind at all to issues surrounding firearms. I am sending this letter to all the supervisors. Brentwood, CA 94513 April 18, 1993 Tom Powers Board of Supervisors Contra Costa County 651 Pine St., Room 106 Martinez, CA 94553 Dear Mr. Powers: I read with interest the article dated 3/24/93 in the Antioch Ledger where it was indicated that you suggested schools teach children about gun safety and that adults learn through similar programs. You and I have played phone tag a number of times without success so I am writing instead to point out an excellent gun safety program , "Eddie Eagle" that was developed by educators and safety professionals. It is put out by the National Rifle Association but it neither offers nor asks for any value judgment concerning firearms. Rather, it has one goal of preventing firearms mishaps with children. It is the most successful program of its kind and is working--accidental gun fatalities among children have been cut in half in the past 15 years. As a father of two and grandfather of four, I am very safety conscious regarding children and firearms. Since I have been an avid hunter, target shooter, and reloader for over 30 years my children were taught from an early age to respect firearms. My two oldest grandchildren (5 and 3) have been given the main message of the Eddie Eagle program. I am enclosing samples of the instructional materials for the Eddie Eagle program and would appreciate your sharing them with the other supervisors. As you know from my letter of February 7th, I don't agree with you on many of your gun control proposals.. However I certainly agree on teaching children and adults proper gun safety, hence�my sending you the enclosed material. I would be happy to provide further material should you desire. Brentwood, CA 94513 February 7, 1993 Board of Supervisors Contra Costa County 651 Pine St, Room 106 Martinez,CA 94553 Dear Supervisors: I have been an avid hunter, target shooter, and reloader for over 30 years and am now a licensed firearms dealer/gunsmith in Contra Costa County. I strongly believe that laws should be directed toward the person committing a crime with a firearm and not the firearm itself. I am extremely dismayed to see that you are considering a county ordinance to require "mug shot" photographs and fingerprinting to buy or possess firearms and ammunition. Apparently this idea is in response to the recent tragic killing of two Richmond police officers. I concur that such needless violence needs to be curbed but not by putting additional and expensive burdens on honest law-abiding citizens and businessmen such as myself. As you must be aware, California already has some of the strictest gun laws in the country including a 15 day waiting period and Dept. of Justice check. These laws do nothing to stop the criminal or mentally deranged person from commiting a crime with a firearm or by some other means; such people have no regard for the law. I recognize it is easier to attempt reform by going after inanimate objects rather than the human beings responsible for crime; appeal to emotion during such tragedies is easy. I believe a better use of county funds would be to buy every peace office a Kevlar body armor vest and to put more deputy sheriffs on patrol. I support legislation that invokes stronger penalites for crimes committed with a firearm, and a strengthening of the criminal justice system that currently puts repeat offenders back on the street. You need to work to reform the criminal justice system and ensure swift, sure and severe punishment of criminals. I am in total opposition to your idea of an ordinance to penalize law-abiding citizens. In fact.such an ordinance if passed would probably be unconstitutional with respect to the 2nd Amendment of the U.S. Constitution. Also a county cannot pass ordinances that go against state law so it would be illegal. I would appreciate a response from each of you regarding your position on this draft ordinance concept.
