MICHAEL WALFORD, PUBLIC WORKS DIRECTOR DATE: APRIL 26, 1994 SUBJECT: REQUEST THE CONTRA COSTA COUNTY FLOOD CONTROL AND WATER CONSERVATION DISTRICT TO ADOPT THE STORMWATER UTILITY ASSESSMENT LEVIES FOR STORMWATER UTILITY AREA 17 (UNINCORPORATED COUNTY) FOR FISCAL YEAR 1994-95 AT AN EQUIVALENT RUNOFF UNIT (ERU) RATE OF $16.20. )EST(S)OR RECOMMENDATION(S)& BACKGROUND AND JUSTIFICATION 1. Recommended Action: ,REQUEST the Contra Costa County Flood Control and Water Conservation District to adopt the stormwater utility assessment levies for Stormwater Utility Area 17 (unincorporated County) for FY 1994-95 at an Equivalent Runoff Unit (ERU) rate of $16.20. [I. Financial Impa The 1994-1995 rate per ERU is the same as that setforfiscal year 1993-1994. Therefore, there will be no change in rate for unincorporated County property owners. The unincorporated area of Contra Costa County will produce approximately$1,489,900 which will be used to pay the costs associated with implementing Contra Costa County's Stormwater Management Plan, III. Reasons for Recommendations and Background: Under the Federal Pollution Control Act, prescribed discharges of stormwater require a permit from the appropriate California regional water quality control board underthe National Pollutant Discharge Elimination System (NPDES) Program. The County applied for and received an NPDES Permit which requires the implementation of selected best management practices to minimize or eliminate pollutants from entering stormwaters. Reasons for Recommendations and Background: (Continued) The County intends to utilize funds received from the stormwater utility area for implementation of the NPDES Programand drainage maintenance activities. The stormwater utility area was formed in 1993, and included the adoption of Stormwater Utility Assessment Drainage Ordinance No. 93-47 which set the rates for fiscal year 1993-1994. The Stormwater Utility Area and Program Group Costs Payment Agreement between Contra Costa County and the Contra Costa County Flood Control and Water Conservation District requires that the County annually, by May 1, determine the rate to be assigned to a single ERU for the forthcoming fiscal year. IV. Consequences of Negative Action: If the rate per ERU is not set for the coming fiscal year, funds will not be available for the implementation of the County Stormwater Management Plan. The regional boards have the authority to issue fines of up to $10,000 per day and $20.00 per gallon of discharge against those municipalities that fail to implement their Stormwater Management Plans or fall into non- compliance with the Permit.
