Weed Abatement Contract Extension SPECIFIC REQUEST S) OR RECOMMENDATIONS ) & BACKGROUND AAD JUSTIFICATION Recommendation: Authorize the Acting Fire Chief of the Contra Costa County Fire Protection District to execute a contract extension with Johnson and Beneke, Inc . for the continuation of weed abatement services within the Contra Costa County Fire Protection District through December 31, 1994 after receipt and review of required bonds, certificates of insurance and other required documents . Reasons for Recommendation / Background: Weed abatement contracts with Johnson and Beneke, Inc. for exterior fire hazard control by Discing and Bulldozing and by Mowing, Rubbish and Tree Removal terminated on December 31, 1993 . The Fire District prepared a new contract which was let out for bid by the Board of Supervisors on February 8, 1994 . Only one bid was received and was rejected by Board Order on April 19 , 1994 . Time has now become a serious problem. There is not sufficient time to re-bid the weed abatement contracts and put them in place before conditions would become critical . Due to prevalent weather conditions, dry grass and weeds and piles of combustible rubbish present an extreme threat of fire to the residents of Contra Costa County. It is essential that the Fire District have the ability to abate these hazards in accordance with Contra Costa County Ordinance 89/68 when the owner fails to do so in order to reduce the potential for a catastrophic wildland fire from occurring. In accordance with provisions of Contra Costa County Ordinance 94/34 , the Fire District contacted Johnson and Beneke, who have agreed to renew the 1993 contract for one year with minor modifications. Johnson and Beneke has been very reliable, performed well and is familiar with both the area and the work to be done. The Fire Chief is being authorized to sign the contract for the Board after the contractor has signed the contract and returned it, together with the required bonds, certificates of insurance and other required documents, and the District staff has reviewed and found them to be sufficient. Pursuant to Public Contract Code Section 4114, the Board DELEGATES its functions under Public Contract Code Sections 4107 and 4110 to the Fire Chief or his designee. Fire Chief SUBJECT: Weed Abatement Contracts J Pursuant to our meeting of March 30, 1994 relative to the weed abatement contracts, the Fire District contacted the contractors who, had the 1993 contracts . One contractor, Johnson & Beneke, agreed to extend the 1993 contract to cover the . 1994 season with some minor modifications . Attached is a copy of a draft Board Order authorizing the contract extension and a copy of the extension contract for your review. Please review these documents at your earliest convenience and advise either myself or Mike Argo if they are acceptable to you. We need to have this placed on the Board agenda for their approval at the Board meeting on April 26, 1994 . If you have any questions, please give either myself or Mike a cull . To extend the 1993 Contracts for Exterior Fire Hazard Control ( "contracts" ) between the parties dated June 15, 1993, for one ( 1) year from December 31, 1993 to December 31, 1994 . 2 . To affirm all other terms and conditions of the contract which shall remain in full force and effect except as modified herein. 3 . To require evidence of all bonds and certificates of insurance as set forth in the contract for this additional year to be extended and provided to the District before any work hereunder can begin. 4 . To increase the amount of insurance required in Section B. 1 . of the Specifications for Exterior Fire Hazard Control as follows : A. To reduce the amount of the bonds required in Section B.2 . of the Specifications for Exterior Fire Hazard Control as follows : A. A bond in an amount equal to fifty percent (50%) of the total bid for one year's work for the payment of just claims for materials, labor and subcontractors employed thereon. B. A bond in an amount equal to fifty percent (50%) of the total bid for one year's work as surety for the faithful performance of the contract. 6 . To increase the rates indicated on page 3 of the Bid Proposals for Hand Mowing, Rubbish Removal Hand Load - Small Truck, and Labor for Miscellaneous Work to $22 . 00 per hour and increase the rate for Discing with Wheel Tractor and Discing with Crawler Tractor to $68 . 25 per hour. 7 . To clarify the intent of the term "travel time" as used in Section E. 9 .A. ii . of the Specifications for Exterior Fire Hazard Control to mean the amount of time to travel from one job site to the next and does not include the amount of time to travel to or from the contractor' s facilities to the job site.
